ORDINANCE CHANGING ZONING C LAS S IF ICAT I ON OF CERTAIN PROPERTY LOCATED WITHIN CITY OF BATESV ILLS , ARKANSAS FROM RESIDENTIAL CLASSIFICATION TO COMMERCIAL CLASSIFICATION Whereas, the City Planning Commission of the City of Batesville, Arkansas, on the 8th day of February, 1962, pursuant to notice given as required by law, held a public hearing at the City Hall of the City of Batesville, Arkansas, for the purpose of considering the proposed reclassification of three tracts of land from Residential District to C -I, "Central Business District", said tracts being described as follows: Tract 1: Commencing at the Northwest corner of the John F. Allen old home property, now awned by B. Woods (it being the intersection of Harri- son and Allen Streets in the City of Batesville, Arkansas, and on the South side of Harrison and the East line of Allen Street), and run thence East along the South line of Harrison Street a distance of 150 feet to the East line of an Al- ley called "Harrison Street Alley", for place of beginning; thence East along the South line of Harrison Street 140 feet to the West line of the property formerly owned by A. L. Crouch, Sr., and now owned by J. M. Hooper; thence South a- long the West line of said last named property 150 feet; thence West and at right angles to Harri- son Street 140 feet to a point on the East line of said Harrison Street Alley; thence North a- long East line of said Alley 150 feet to the place of be inning on Harrison Street, it being part of a ong block sometimes called Block 3 of Bates Addition to the City of Batesville and being the property recently conveyed to J. M. Hooper by J. W. Williamson, et al by deed dated May 14, 1937, recorded in Book P-5, page 150. Tract 2: Lot 1 of Fractional Block of Bates Addition to the Town (now City) of Batesville, more fully described thus: A strip off of the East side of Block, 60 by 150 feet in the shape of a parallelogram extending West from the alley between Blocks 2 and 3; it being the North Half (N-'-2) of the same real property as was conveyed by a certain deed now recorded in Book K-4 at page 381 of the deed records of said county. Tract 3: A tract of land beginning at a point on Harrison Street 40 feet East of the extreme Eastern line of the property known (said point beginning being at the intersection of Harrison Street and Allen Street, City of Batesville, Ark.); thence South along the East line of Street, 175 feet to rock for corner; thence East and at right angles to Allen Street and parallel with Harrison Street, 80 feet; thence North parallel with Allen Street and at right angles to Harrison Street 175 feet to the South line of Harrison Street; thence West along the South line of Harrison St. 80 feet to the place of beginning, being a part of the West Half (W2) of the Southwest Quarter (SW -14) of Section 16, Township 13 North, Range 6 West, and known as the John F. Allen homeplace. Tracts 1 and 2 belong to Aneel L. Adams and Tract 3 belongs to Malcom Moore and Edith Mone, his wife. And whereas, the City Planning Commission, pursuant tc law, has filed its recommendations Vith the City Council, recom- mending the following action as concerns the reclassification: 1. That Tract 3, as above described, belonging to Mal- com Moore and Edith Moore, be changed to classification of C-11 "Central Business District." 2. That Tract 22 as above described belonging to Ansel L. Adams be changed to Classification of C-13 Central Business District", but that Tract 1 as above described, remain as a Resi- dential District. NOW THEREFORE, BE IT ORDAINED BY THE City Council of the City of Batesville, BE Section 1: That the City Council adopts the report and recommendation of the City Planning Commission as above set forth, and that Tract 3 as above described, be and is hereby re- classified under the applicable zoning law and regulations to the class of C-1, Central Business District", and that likewise, Tract 2 as above described, be and the same is hereby reclassified] under the applicable zoning law and regulations to the Class of C-1, Central Business District and that Tract 1 as above described] is not reclassified, but shall retain its classification as Resi- dential property at this time, without prejudice to the owner of Tract 1 to later ask for reclassification under applicable law and regulations of this city. Section 2: That the City Clerk shall cause the official zoning map to note the changes above set forth. Section 3: That there is hereby found and declared to be an immediate need for the relcassification above set forth for the benefit of the public health, safety and wd.fare of the Citi of Batesville, Arkansas, and particularly the area affected here- by. Therefore, it is declared that an emergency exists and this ordinance being necessary for the immediate preservation of the public health, safety and welfare shall be in farce and take ef- fect immediately upon and after its passage.
