ORDINANCE VACATING ALLEY IN PART OF BLOCK 6,
RAMSSEY ADDITION, BATESVILLE, ARKANSAS
WHEREAS, a petition was duly filed with the City Council
of the City of Batesville, Arkansas, on the <' day of
September, 1962, asking the City Council to vacate andabandon the
alley designated on the plat of Ramsey Addition to said City now
appearing of record in Deed Book Y-3, page 519 in the office of
the Recorder of Independence County, being a ten (10)foot alley
that bisects Block 6 of Ramsey's Addition and being the only alley
in said Block 6.
WHEREAS, after due notices as required by law, the
Council has at the time and place mentioned in the notice heard
all persons desiring to be heard on the question and has ascertained
that the alley hereinbefore described has heretofore been dedicated
to the public use as an alley herein described; has not been
actually used by the public generally for a period ofat least five
years subsequent to the filing of the plat; that all of the owners
of the property abutting upon the portion of the alley to be vacated
have filed with the Council their written consent to such abandon-
ment, but that John Moody and Angie Moody later asked that their
consent be withdrawn; that John Moody and Angie Moody are the
owners of Lot 1 and the West 30 feet of Lot 2 of said Block 6 of
Ramsey Addition, Batesville, Arkansas; that public interest and
welfare will not be adversely affected by the abandonment of such
alley as to all of said block except that part between Lots 1 and
10 and between West 30 feet of Lots 2{� and 9 of said Block 6, of
Ramsey's Addition, Batesville, Arkansas.
NOW, THEREFORE, be it ordained by the City Council of
the City of Batesville, Arkansas:
1. The City of Batesville, Arkansas, hereby releases,
Jvacates and abandons all its rights, together with the rights of
the public generally, in and to the alley designated as follows:
A 10 foot alley that bisects Block 6
of Ramsey's Addition to the City of
Batesville, Arkansas, as shown in Deed
Book Y-3, page 519 in the office of the
Circuit Clerk of Independence County,
Arkansas; said alley being the only
alley in said Block 6 of Iansey's Addition
and running in a generally East - West
direction, except that part of said
alley between Lot 1 and 10 and that part
of said alley between West 30 feet of Lots
2 and 9 of said Block 6, Ramsey's Addition,
Batesville, Arkansas.
2. A copy of the ordinance duly certified by the City
Clerk shall be filed in the office of the Recorder of the County
and recorded in the deed records of the County.
