HomeMy WebLinkAbout2012-01-04 ORDINANCE NO. 2012-01-0!1 AN ORDINANCE TO AMEND VARIOUS PROVISIONS OF THE BATESVILLE ZONING CODE; TO MODIFY CERTAIN PROVISIONS RELATING TO REQUIRED CONDITIONS FOR USES IN GENERAL INDUSTRIAL ZONING DISTRICTS; AND FOR OTHER PURPOSES. WHEREAS,certain provisions of the Batesville Zoning Code with respect to required conditions for permitting uses in General Industrial Districts [I-2]are inappropriate;and, WHEREAS,updating these provisions is desirable to allow for appropriate industrial development in the City of Batesville;and, WHEREAS,the Batesville Planning Commission has prepared recommendations to improve the efficient and effective application of the Batesville Zoning Code,and conducted a properly advertised public hearing on December 6,2011, NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BATESVILLE,ARKANSAS THAT THE BATESVILLE ZONING CODE IS HEREBY AMENDED AS FOLLOWS: Section 1. General Industrial District[I-2] Required Conditions The fust sentence of Title 14,section 14.08.02.B.I of the Batesville Municipal Code is hereby deleted in its entirety. Said section shall be replaced and shall now read as follows: © 1. All outside storage shall be screened by a site obscuring fence or shrub. IF ANY PORTION OR PORTIONS OF THIS ORDINANCE ARE DEEMED OR HELD TO BE INVALID,SUCH INVALIDITY SHALL NOT EFFECT THE REMAINING PORTION OR PORTIONS OF THIS ORDINANCE. IT IS SO ORDERED.
