WH7REAS, it appears to the Co>>ncil of the City of Batesville, Ark.
that certain hereinafter described territory contiguous to the said
City of Batesville, Arkansas is necessary for the expansion, growth,
and development of said City, the-efore,

Section 1. That there shall be su-binitted to the le. --al voters of the
City of Batesville, Arkansas, to be voted upon at the municipal General
Election to be held on November 5, 1963, the question of the annexation
of certain herein descriibed territory, contiguous to said City and.
within the same County; and that the officials of the City of Eatesville
Arkansas take all other steps necessary to complete the annexation;
said territory to be annexed is described as follows:

Beginning at the comer between Sections 15, 16, 21, and 22, Town -
Ship 13 North., Range 6 West, thence Northerly along and with the West
line of the Batesville Country Property 2300 feet more or less to a
point; thence continueing East along the line of said Country Club
property a distance of 400 feet; thence South along said Club line a
distance of 215 feet; thence along said Club line and an extention
thereof, a distance of 1448 feet more or less to the West or South
line of Highway No. 69; thence Northerly and Westerly along the West
or South line of said Highway No. 69 a distance of 2915 feet to the
line between Sections 15 and 16 aforesaid, being the West line of
20th Street; thence South along said West line of 20th Street a dis-
tance of 2080 feet more or less to the point of beginning; this being
the tract gown as "Fitzhugh Park Addition" and recorded in Deed
Record Book I-7, page 241q containing 50 acres more or less.
TRACT #2
Beginning at a. point on the South. line of Main Street immediately
South of the line between the Powell Motel and Ball Addition, being
also 65 links West of the North-South center line of Section 9, Town-
ship 13 North, Range 6 West; thence North on the Powell Motel -Ball
Addition line a distance of 1000 feet more or less to a point where
a prolongation of the North line of Rock Street would strike the same;
thence South 54 degrees West along said line 700 feet, more or less to
the Center line of Cedarwood Drive; thence Northeasterly along said
line 700 feet more or less to Bluff Drive; thence West along. Bluff
Drive 300 feet more or less to the West line of the old Batesville-
Smithville road; thence Northeasterly alonF- said West line of the
Batesville-Smithville road a distance of 50 feet more or less to the
South right of way line of the Missouri Pacific Railroad; thence
Easterly along. said Railroad right of way a distance of 2500 feet more
or less to the line between the E2 and the W2 of the SE! of Section
9, Township 13 North, Range 6 West; thence South on said line a distance
of 650 feet more or less to the East line of Highway No. 167; thence
Southwesterly along said Last line of U.S. Highway No. 167 a distance
Of 700 feet more or less to the extention of Main Street; thence in
a generally Western and Southwestern direction along the said extention
of Main Street a distance of 1400 feet more or less to the Point of
Beginning, containing 36 acres, more or less.

Beginning at the corner between Sections 7,8,17, and 18, Township
13 North, Range 6 West, thence South on the line between the said
Sections 17 and 18 a distance of 850 feet to the South line of High-
way No. 106 being. the South. boundry line of Maxfield's Western Addition
to the City of Batesville; thence east along said South line 1950
feet more or less to the Tigest line of Elsie Street; thence South 36
degrees Fast alone, said line of Elsie Street a distance of 700 feet
to a point on the extension of the South. line of Carter Street; thence
South 54 degrees West along, the extension of the said South _line of
Carter Street 1160 feet to the line between the Cooper tract and
Leonard's Addition; thence South on said. line 11.20 feet to the North
right of way line of the :-Iissouri Pacific Railroad; thence aJasterly
along, and with said Railroad right of way and the line of Leonard's
Addition a distance of 950 feet to the center of Dry Run; thence
Northerly along, the center of Dry Run a distance of 2.900 feet more or
less to the line between Sections 7 and 18 aforesaid; thence ',last on
said line a distance of 400 feet more or less to the Point of Beginning,
containing; 75 acres, more or less.

Beginning at the corner between Sections 8,9,17 and 18, Township 13
North, Range 6 West; thence West along the _line between Sections 8 and
17 aforesaid a distance of 750 feet to the Southeast Corner of the West
Batesville School property; thence North along; the East line of said
School property a distance of 333.3 feet; thence West on the North. line
of said School property a distance of 881.7 feet to the Fast line of
Hill Street; t`-ience North along; the Ja^,t line of Hill Street a d_ittance
of 2461 feet more or less to the line between the S2 and the N2 of
Section 8 aforesaid; thence West along said line 1800 feet more or less
to the East line of highway No. 69; thence North alon- the east line
of said Highway a distance of 1350 feet more or 7_ess to the line be-
tween the N2 and the S2 of the 'BTW � of Section 8 same be inF the South.
line of the road along the South side of the Fairgrounds; thence 7,Fast

of 465 feet to the Southwest corner of the Deshong tract; thence North
along the 'gest line of said tract a distance of 467 feet to a point;
thence cast along the North line of said tract a distance of 700 feet
to a point; thence South along the ,'ast line of said tract a distance
of 467 feet to a point; thence West a distance of 150 feet to the Worth
west corner of the 'vloody tract;thence South alone said Moody tract a
distance of 253 feet to a, point; thence West alon€; the line of said
Moody tract a distance of 115 feet to a point; thence South along the
line of said Moody tract a distance of 437 feet to a point; thence East
along the line of said. :Moody tract a distance of �i572 feet to the
southeast corner thereof; thence South 660 feet more or less to the
line between the N2 and the S2 of Section 8; thence East alon`; said lir

Section ?. The ballots used at said election on the question of
annexation shall be m.arlced as follows:

Section 3. That there is hereby found and declared to be an immedi-
ate need for the passage of this Ordinance for the benefit of the pub-
lic health, safety and welfare of the City of Batesville, Arkansas,
TrEREFORE, it is declred that an emergency exists and this Ordinance
being necessary for the immediate preservation of the public health
safety and welfare .shall be in force and take effect immediately upon
and after its passage.
