AND ASSIGNING SAME TO WARDS
WHEREAS, a petition was filed with the County Clerk of Indepen-
dence County, Arkansas by the City of Ea.tesville, Arkansas through
its mayor acting on instruction and under autthority of its City
Council, said petition praying that the hereinafter described terri-
tory be annexed to, and made a part of the City of Batesville, Ark,
and;
WPERHAS, on the 16th day of December, 1963, the County Court of
Independence County, Arkansas found said petition to be in order; that
said territory was contagious and adjoining the present corporate limits
Of the City of Batesville, Arkansas; that an accurate plat or map of
said territory had been filed with, and made a part of said petition;
that proper notice had been f-iven for the time and in the manner pre-
scribed by law, and that all things pretaining thereto had been done
in the manner prescribed by law,and that said lands and territory
should be annexed to and made a part of the City of Batesville, irk.,
,subject to acceptance of same of the City Council of said City at the
proper time as provided by law, and
WHEREAS, the time fixed by law for appealing from said order of
annexation made by the County Court has expired and no appeal has been
taken from said order,

Section 1 ---That the following, described lands and territory con-
tigious and adjoining the City of Batesville, Ark., be and the same is
her-eby accepted as a part of and annexed to and made a part of the
City of Batesville, Ar-._ansas:
TRACT #1
Beginning at the corner between Sections 15, 16,21, and 22, Township
13 North, Range 6 West, thence Northerly along and with the West line
of the Batesville Country Club property 2300 fest more or less to a
point; thence continuing East along the line of said Country Club prop-
erty a distance of 400 feet; thence South along said Club line a dis-
tance of 215 feet; thence alonc said Club line and an extention thereof,
a distance of 1448 feet more or less to tie West or South line of High-
way I`69; thence Northerly and Westerly along the eJest or South line of

taining 50 acres, more or less.

Beginning at a point on the South line of Main Street immeidately south
of the line between the Powell '01otel and Ball Addition being also 65
links West of the North-South center line of Section 9, Township 13 N,
Range 6 West; thence North on the Powell Idotel Ball Addition line a
distance of 1000 feet more or less to a point where a prolongation of
the North line of Rock Street would strike the same; thence South 54°
West along said line 700 feet more or less to the center line of Cedar -
wood Drive; thence Northeasterly along, said line 700 feet more or less
to Bluff Drive; thence West along Bluff Drive 300 feet more or less to
the West line of the Old Batesville-Smithville road; thence 14ortheaster]
along said West line of the Batesville-Srnithvill road a distance of
50 feet more or less to trie South right of way line of the :%iissouri
Pacific Railroad; thence Easterly along said railroad right of way a
distance of 2500 feet :more or less to the line between the East half

more or less to the Fast line of highway No. 167; thence Southwesterly
along said East line of U.S. Highway 167 a distance of 700 feet more

17 and 18 a distance of 850 feet to the South line of highway #106
being the South boundry line of Illaxfield's Western Addition to the
City of Batesville; thence :east alon; said aouth line 1950 feat more
or less to the',h'est line of Street; thence South 36° East along
said line of Elsie Street a distance of 700 feet to a point on the
extension of the South line of Carter Street; thence South 540 West
along the extension of the Said South line of Carter Street 1160 feet
to the line between the Cooper tract and Leonard's Addition; thence
South on said line 420 feet to the North bight of vvay line of the

District from A.L. Rogers and wife as aforesaid; thence East 110 feet
to the Northeast corner of sail A.L. Rogers tract; thence South 96 feet
to the Point of Beginning.
Section 2--- That the above described territory shall be annexed
to and made a part of 4ards in the said City of Batesville in the
following manner: (a) Tract #1 to be a part of 'ward,; (b) Tract
#2 to be a part of Ward -. ; (c) `.tract #3 to be a part of Ward

and fid) Tract #4 to be a. part of vy�ard ; all and
each of said tracts to be a part of such respective wards as fully and
completely as the existing parts of said wards as of the date of this
Ordinance.
Section 3 ---This Ordinance appearing necessary for thepublic
health, safety, and welfare of the City of F;atesville, Ar'>ansas, an
emergency is he_-eby declared to exist and the same shall be in full
force and effect from and after its passage.
