AN ORDINANCE ACC FPZ' IrTt T''i a A':1IvEXAT _TO i1 OF CERTAIN TH,'RR.T_TO!iY TO TY,,,' C 1TY Or BATH -',V IL11-,E, ARKANSAS, AND MAKING SA_,!A PA_�'T' Ori ` F7_'_ CITY OF BA R'SVILLE, AND ASSIGNING SAME TO WARDS WHEREAS, a petition was filed with the County Clerk of Indepen- dence County, Arkansas by the City of Ea.tesville, Arkansas through its mayor acting on instruction and under autthority of its City Council, said petition praying that the hereinafter described terri- tory be annexed to, and made a part of the City of Batesville, Ark, and; WPERHAS, on the 16th day of December, 1963, the County Court of Independence County, Arkansas found said petition to be in order; that said territory was contagious and adjoining the present corporate limits Of the City of Batesville, Arkansas; that an accurate plat or map of said territory had been filed with, and made a part of said petition; that proper notice had been f-iven for the time and in the manner pre- scribed by law, and that all things pretaining thereto had been done in the manner prescribed by law,and that said lands and territory should be annexed to and made a part of the City of Batesville, irk., ,subject to acceptance of same of the City Council of said City at the proper time as provided by law, and WHEREAS, the time fixed by law for appealing from said order of annexation made by the County Court has expired and no appeal has been taken from said order, NOW THE. tF'FOiiE BE IT R i SOLV-[ D ALS; D 0,i_)AI!4.�D EY 'i'��. Section 2--- That the above described territory shall be annexed to and made a part of 4ards in the said City of Batesville in the following manner: (a) Tract #1 to be a part of 'ward,; (b) Tract #2 to be a part of Ward -. ; (c) `.tract #3 to be a part of Ward F and fid) Tract #4 to be a. part of vy�ard ; all and each of said tracts to be a part of such respective wards as fully and completely as the existing parts of said wards as of the date of this Ordinance. Section 3 ---This Ordinance appearing necessary for thepublic health, safety, and welfare of the City of F;atesville, Ar'>ansas, an emergency is he_-eby declared to exist and the same shall be in full force and effect from and after its passage.
