AN ORDINANCE TO WAIVE COMPETITIVE BIDDING AND
AUTHORIZE PURCHASE OF A PUMPER TRUCK FOR THE CITY OF
BATESVILLE FIRE DEPARTMENT
WHEREAS, the City of Batesville Fire Department's current Pumper truck
recently experienced severe maintenance problems which require extensive and
costly repairs;
WHEREAS, the current Pumper truck suffered multiple other mechanical
failures in the recent past, attributable to its age;
WHEREAS, it has become necessary to procure a replacement Pumper
truck for the City of Batesville Fire Department; and
WHEREAS, the City of Batesville Fire Department, through Chief Brent
Gleghorn have recommended the matter be referred to the full Council for
approval.
• NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
BATESVILLE, ARKANSAS:
Section 1. That it is necessary for the City of Batesville Fire Department to
purchase a Pumper Truck and that, specifically, the equipment shall be as
described herein as follows:
Rosenbauer 2011 International Dura Star 440 Class A Pumper
Section 2. That said equipment is to be purchased from the Rosenbauer
Company for the approximate sum of$195,000.00 more or less.
Section 3. That, since competitive bidding is not feasible or practical
because of the immediate need for the equipment, the City Council in accordance
with the terms of Ark. Code Ann. § 14-58-303(b)(2)(B) hereby waives the said
bidding requirements and directs the Purchasing Officer to purchase the above
described equipment for the price set forth in Section 2 above.

• Section 4. EMERGENCY CLAUSE: It is further found that due to the
immediate need to acquire the above described equipment, an emergency is
declared to exist and this ordinance being necessary for the preservation of the
public peace, health and safety shall take effect from and after its passage and
approval.
