P1iR")ON-Th.e word "person" shall mean and include both the siggular and plural and shall also mean and include person, individual, firm, corporation, co -partnership, association, club, society, or any other organization. to MOBILE hO,Rl-The word "mobile home" allodes/any structure with the following characteristics: a. It is designed for long term occupancy and contains a flush toilet, tuk- or shower bath, k_tchen facilities, and sleeping Quarters. b. It is desi`_ned to be transported after fabrication (manufacture) on its own wheels, or on a flat-bed or other vehicle. c. it arrives at the site where it is to be occupied as a complete dwelling unit, includin.� major appliances and. furniture, and ready for occupancy except for minor and incidental unpacking. and assembly oper- ations, location on jacks or other temporary or permanent foundations, connections to utilities and the like. MOB -I E H0'Y1 , SPAC -A plot of ;.;round within a mobile home park de- si-ned for the acco:^riodytion of one mobile home. {CTION 2 -Except as otherwise provided h^rein, xm mobile homes°.in the City of Batesville shall, from and after passage of this orlinance, be located only in mobile home parks and no such park shall be situated in any area of the City of Batesville which is zoned for residential purposes. SECTION 3 -It shall be unlawful for any person to operate a mobile home park in tl)e City of Batesville without first obtaining a permit to do so. Such permit is to be obtained by making; application therefore with the Office of the City Clerk. The application shall be in writing, signed by the applicant, and shall include the following: a. The name and address of the applicant. b. The location and legal description of the mobile home park. c. A complete plan of the park showing; that it complies withxll requirements and regulation hereinafter set forth. d. Plans of all buildings, improvements and facilities constructed.. or to be constructed within the mobile home park. e. Such further information as may be required to c'etermine if the proposed park will comply with all remulations and requi.rments of the City of Batesville, The application and all acompanyi.ng plans and specifications shall be filed in triplicate and if the applicant is of sound moral character and the mobile home park meets all requirments and regulations containQd herein, the permit for operating such as a mobile home park_, shall be issued. -1- SECTION 4- Mobile Home Parks in the City of Batesville shall con- form to the following requirments: a. The par',c :hall be located. on a well drained site, properly graded to insure repid drainage and freedom from stagnant pools of water. b. Mobile home spaces shall be provided consisting of, a minimum of 2400 square feet for each space which shall be at leastfeet wide and clearly defined. c. Ylobile homes shall be so placed upon each space that there shall be at least a 15 foot clearance between mobile homes. d. All mobile home spaces shall abut upon a driveway of not less than 30 feet in width, which shall have unobstructed access to a public way. e. All driveways and walkways within the pRrk shall be hard -surfaced and lighted at night. f. An electrical outlet supplying at least 110 volts shall be pro- vided each mobile home space. g. Public water shall be provided to all mobile home spaces within the park. h. All waste water shall be discharged into a public sewer system or into a private sewer system in such a manner as will present no health hazard, and which is approved by the City Health Officer who shall have the power to make periodic inspections of mobile home parks to see that all health and sanitary regulations of the City are being observed therein. i. :Metal garbage cans with tight fitting covers shall be provided each mobile home space to permit adequate disposal of all garbage and rubbish. C .CTICN 5 -It shall be the duty of each mobile home park owner issued a pern;it under the terms of this Ordinance to keep a register containing a record of all mobile home owners and occupants located within the mobile home park. This register sh-Q.11 contain the following information: a. The name and address of each mobile home occupant. b. The name and address of the owner of each mobile home and motor vehicle by which it w.ps towed. c. The make, model, year and license number of each. mobile home and motor vehicle. d. The date of arrival and departure of each. mobile home. Provided further, it shall be the duty of each mobile home park operator to promptly notify the City Building Inspector each time that a mobile home is placed on location in a mobile home space within said park. SHCTION 6 -Upon notification as provided in Section 5 above, it shall be the duty of the City Building Inspector to make an inspection of said mobile home park to insure that the requirements and retoulations of this Ordinance are being complied with. SECTION 7 -In order to defray the costs of administering the provi- sions of this Ordinance, an inspection fee of 43.00 for each mobile home placed on location in a mobile home park, is hereby levied on such mobile home gk owner. -2- CM SECTION 8 -No portion of this ordinance shall be construed to pro- "^ibit any property owner within the City of Batesville from permanently placing a mobile home on rAs property provided that in so doing, said property owner complies with the other ordinances and rPr,;ulations of said city pertaining to the erection of a residence; provided further, that when a property owner places a mobile home on his own property, the following epedific requirements must be met: Y a. The mobile home shall be supported under the exterior walls by a foundation and. the wheels are to be removed. 3 b. The mobile home shall be taxed as real property and be assessed as such by the property owner. SB'CTIO119-Any person who shall violate any of the provisions of this Ordinance shall, upon conviction trierefor, be :Uxxt deembd guilty of a misdemeanor and shall be fined not less than _ /f nor more than and every day that such violation continues to exist shall ,onstitute a separate offense. SB'CTIOT: 10 -It beim; necessary for the preservation of the health and welfare of the City of Batesville that thJs Ordinance take effect as soon as possible, an omergency is hereby declared and this Ordinance shall take affect immediately upon and after 3_ts passage.
