AIT ORDINAiTCF� "'BAKING IT UNLA IFUL FOR AITY Pi_;RSON, FIR143 OR CO"DOnATICTT TO DISTRIBUTE LITT HSR, REFUSE ,11 -TD DEBRIS UPOIT ANY STRE 'T , SIDEWALK OR PUBLIC THROUGHFARE OR ANY PRI- VATE OR PUBLIC PROPERTY ADJACENT TH ERETO, PROVIDING A PENALTY TH.TEFORK, DECLARING AN EMERGENCY AND FOR OTH �,R PURPOSES j..� l 'r eu WHEREAS, the distribution of litter, refuse and debris upon the public streets, alleys, sidewalks and thoroughfares is a prevalent, un- sightly, and unsanitary condition which now exists in the City of Batesville; and, udHREAS, there is no legal prohibition at the present time against the distribution by the general public of litter, refuse and debris on C. and about the public throughfares in this City; and, WHEREAS, it is the will of the City Council of the City of Bates- ville to make unlawful the distribution of litter, refuse, and debris upon the public throughfares of said City, NO'v, THEREFORE BE IT ORDAIN',0 BY THE]' CITY COUNCIL OF TH CITY OF BATESVILLE, ARKANSAS: Section 1 - That from and after the passage and approval of this ordinance, it shall be unlawful for any person, firm, or corporation to place, dispose, or otherwise permit to be located upon, in, on, or about any public street, sidewal4, alley or public thoroghfare or any private or public property adjacent thereto, any litter, refuse, or debris. Section 2- Any violation of this ordinance shall be deemed a mis- demeanor, and upon conviction therefor, the Violator of this ordinance shall be fined in a sum not to exceed 25.00 dollars together with costs. Section 3- All ordinances or parts of ordinances in conflict herewith are hereby repealed. Section 4- The City Council has determined that the distitbution of litter„ refuse, and debris upon the public thoroughfares of the City of Batesville and upon public and private property adjacent thereto has wig .created, and continues to cred46 a condition that is unsightly, unhealthy and unsafe and this ordinance is necessary to relieve said condition immediately THEREFORE, an emergency is hereby declared to exist and this ordinance being necessary for the immediate preservation of the public peace, health, and safety shall be in full force and effect from and after its passage and approval.
