HomeMy WebLinkAbout2012-05-02 • ORDINANCE NO. 2012-06-_(2g AN ORDINANCE TO WAIVE COMPETITIVE BIDDING AND AUTHORIZE THE BATESVILLE WATER DEPARTMENT TO CONTRACT FOR WATER TREATMENT CONTROL SYSTEM AND ELECTRICAL REPAIRS WHEREAS, the City of Batesville Water Department's water treatment control system recently experienced several electrical problems which require extensive repairs; WHEREAS, the reliable operation of the water treatment control system is vital to the continuing safe operation of the plant, as well as the public health and safety, and said system requires immediate electrical repairs; WHEREAS, it is necessary for the public health, safety and welfare to repair the electronic water treatment control system as soon as possible; WHEREAS, the nature of the repairs necessary at the water treatment • facility are unique and are the province of few companies; and WHEREAS, the City of Batesville Water Department, through City Engineer Damon Johnson, has recommended the matter be referred to the full Council for approval. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF BATESVILLE, ARKANSAS: Section 1. That it is necessary for the City of Batesville Water Department to immediately contract for repairs of its electronic water treatment control system. Section 2. That Multi-Craft Contractors, Inc. is prepared to perform the necessary repairs in the most expedient manner available. That Multi-Craft Contractors, Inc., is qualified and capable of performing the highly specialized system and electrical repairs required. Section 3. That said contract is to be in the amount of approximately $300,000.00 more or less, based on the estimate currently available. Section 4. That, since competitive bidding is not feasible or practical ® because of the immediate need for the repairs, as well as the specific and unique • nature of the repairs, the City Council in accordance with the terms of Ark. Code Ann. § 14-58-303(b)(2)(B) hereby waives the bidding requirements and directs the City of Batesville Water Department to enter into the above described contract for on or about the price set forth in Section 3 above. Section 5. EMERGENCY CLAUSE: It is further found that due to the immediate need to acquire the above described services, an emergency is declared to exist and this ordinance being necessary for the preservation of the public peace, health and safety shall take effect from and after its passage and approval.
