HomeMy WebLinkAbout2012-09-01 ORDINANCE NO.40101—Q- I • AN ORDINANCE TO AMEND THE BATESVILLE ZONING DISTRICTS MAP; AND FOR OTHER PURPOSES. WHEREAS,three parcels were annexed into the City of Batesville by Ordinance number 2012-7-2, adopted July 12,2012; and, WHEREAS,the zoning classification of said annexed properties was automatically assigned as Single- Family Residential (R-1), pending review and recommendation by the Batesville Planning Commission of permanent classification; and, WHEREAS,the Batesville Planning Commission has determined, after a public hearing on August 6, 2012,that the territory annexed to the City by said Ordinance should be reclassified from Single-Family Residential (R-1)to Commercial Community(C-1); and, WHEREAS,the Batesville Planning Commission has further determined that the Commercial Community(C-1)zoning classification would be consistent with the current Comprehensive Plan. NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BATESVILLE,ARKANSAS THAT THE BATESVILLE ZONING DISTRICTS MAP IS HEREBY AMENDED TO DESIGNATE THE FOLLOWING DESCRIBED PROPERTY AS COMMUNITY COMMERCIAL [C-11: A tract of land being a part of the N '/z of Section 21,TI 3N, R6W, south of the White River in the City of Batesville, Independence County, Arkansas, more particularly described as follows: • Beginning at an Arkansas Highway and Transportation Department(AHTD) right of way marker(iron pin) at Station 111+60,300 feet left of the centerline of U.S. Highway No. 167, as shown per AHTD Job No. 5640;thence S 02°17'50" E,along said west right of way line, 100.00 feet to the point of beginning; thence S 73009'45"E,210.67 feet;thence N 87'42'10" E,200.00 feet;thence S 02°17'50" E, 500.00 feet; thence S 87042'10"W, 200.00';thence N 75°39'55" W, 207.46';thence S 88°09'25" W,25.22 feet;thence N 02017'50" W, 257.33 feet;thence N 02°17'50" W, 300 feet;thence N 82°48'05" E,25.06 feet to the point of beginning. IF ANY PORTION OR PORTIONS OF THIS ORDINANCE ARE DEEMED OR HELD TO BE INVALID,SUCH INVALIDITY SHALL NOT EFFECT THE REMAINING PORTION OR PORTIONS OF THIS ORDINANCE. IT IS SO ORDAINED.
