SPECIAL MEETING
JUNE 28, 2018
The Batesville City Council met in special session on June 28th at 5:30 pm at the Municipal
Building. Mayor Rick Elumbaugh presided over the meeting. Upon roll call, the following
Councilmembers answered present; Chris Beller, Tommy Bryant, Julie Hinkle, Margaret Henley,
Paige Hubbard, Doug Matthews, Chris Poole and David Shetron. City Clerk Denise Johnston
was also present. City Attorney Tim Meitzen was absent.
Councilmember Bryant moved to approve the prepared agenda. Councilmember Beller
seconded and all voted for.

NEW BUSINESS
A) CONSIDER AN ORDINANCE TO AMEND THE BATESVILLE ZONING CODE
Ms. Diane Lamberth and Ms. Beatrice Moore addressed the council asking to amend the
City's zoning code to include a definition for a "Children's Advocacy Center (CAC)" to
have the same zoning code at a Child Care Facility and a Church. Ms. Lamberth
explained to the council that a Children's Advocacy Center is a place where children from
the ages of 0 to 17 who have been sexually abused can "have a soft place to fall".
Batesville's facility will be the 17th CAC in Arkansas. Ms. Lamberth also said the facility is
not a "shelter'. No one stays the night, however, the facility will offer 24/7/365 support for
children. The facility located in Batesville will be known as Children Advocacy Center of
Independency County. Councilmember Beller introduced the ordinance. Councilmember
Matthews moved to suspend the rules and read the ordinance by title only.
Councilmember Hubbard seconded and the electronic roll call count was 8 for and 0
against. Ms. Johnston read the ordinance by title only. Councilmember Matthews moved
to further suspend the rules and waive the second and third readings. Councilmember
Bryant seconded and the electronic vote was 8 for and 0 against. Councilmember
Matthews moved to adopt the ordinance and Councilmember Shetron seconded. The
electronic vote was 8 for and 0 against. The ordinance was given #2018-06-01. Ms.
Johnston read the emergency clause. Councilmember Matthews moved to adopt the
emergency clause and Councilmember Shetron seconded. The electronic vote was 8 for
and 0 against.
B) CONSIDER A RESOLUTION CELEBRATING THE LIFE OF DON ZIMMERMAN,
EXECUTIVE DIRECTOR OF THE ARKANSAS MUNICIPAL LEAGUE
Councilmember Bryant introduced a resolution to celebrate the life of Arkansas Municipal
League Executive Director Don Zimmerman. Mr. Zimmerman has served as executive
director for the AML for 52 years and will be missed by all 500 cities and towns in
Arkansas. Mr. Zimmerman passed unexpectedly on June 24t". Mayor Elumbaugh read
the resolution in full. Councilmember Bryant moved to adopt the resolution and
Councilmember Henley seconded. The electronic vote was 8 for and 0 against. The
resolution was given #2018-06-01-R.
ADJOURNMENT
There being no further business, Councilmember Matthews moved that the meeting be
adjourned. Councilmember Bryant seconded and all voted for.
