HomeMy WebLinkAbout2018-05-07 SPECIAL MINUTES OF COUNCIL MAY 7, 2018 The Batesville City Council met in special session on May 7t" at 12:00 pm at the Batesville Community Center. Mayor Rick Elumbaugh presided over the meeting. Upon roll call, the following Councilmembers answered present; Chris Beller, Tommy Bryant, Sonya Crafton, Margaret Henley, Chris Poole and David Shetron. Also present were the Admin. Assistant Jennifer Corter and City Attorney Tim Meitzen. City Clerk Denise Johnston and Councilmember Doug Matthews were absent. Councilmember Bryant moved to approve the prepared agenda. Councilmember Henley seconded and all voted for. NEW BUSINESS A) CONSIDER AN ORDINANCE TO AMEND THE BATESVILLE ZONING CODE Mayor Elumbaugh asked Mr. Chad McClure to elaborate on the proposed changes to the zoning code which covers required parking spaces based on the size and type of commercial business. In a recent meeting, the Planning Commission had decided to keep the language that covered the parking requirements but is requesting that a "Waiver of Standards" be added to the code. This would give a developer an opportunity to submit a request for a variance to Code Enforcement in the event the building size is larger than needed parking. Councilmember Shetron expressed some concerns about the special meeting time and place, wanting to make sure the public had input on the matter. Councilmember Bryant noted that a public hearing on the matter had already been held by the Planning Commission. Councilmember Shetron had a few other concerns which was also discussed. Councilmember Bryant introduced the ordinance. Mayor Elumbaugh asked if there was a motion to read the ordinance by title only. Councilmember Bryant so moved and Councilmember Shetron seconded. The roll call was 7 for and 0 against. Mr. Meitzen read the ordinance by title only. Mayor Elumbaugh asked if there was a motion to further suspend the rules and waive the second and third readings. Councilmember Bryant so moved and Councilmember Crafton seconded. The roll call was 6 for and 1 (Shetron) against. Councilmember Bryant made a motion to adopt the ordinance. Councilmember Crafton seconded and the roll call was 7 for and 0 against. Mr. Meitzen read the emergency clause. Councilmember Bryant moved to adopt the emergency clause. Councilmember Hubbard seconded and the roll call was 6 for and 1 (Shetron) against. The ordinance was given #2018-05-01. ADJOURNMENT There being no more business, Councilmember Bryant moved that the meeting be adjourned. Councilmember Henley seconded and all voted for.
