JUNE 18, 2019
The Batesville City Council met in regular session on June 18, at 5:30 pm at the
Municipal Building. Mayor Rick Elumbaugh presided over the meeting. Utility Office
Manager Nick Baxter gave the invocation. Upon roll call, the following Councilmembers
answered present; Tommy Bryant, Scott Fredricks, Julie Hinkle, Paige Hubbard, Fred
Krug, Doug Matthews and Chris Poole. Also present were the City Clerk Denise
Johnston and City Attorney Tim Meitzen.
Councilmember Fredricks moved to approve the minutes from the previous two
meetings. Councilmember Hinkle seconded and all voted for.
Councilmember Hinkle moved to approve the prepared agenda. Councilmember
Hubbard seconded and all voted for.

A) POLICE DEPARTMENT REPORT
Police Chief Alan Cockrill address the council with his Monthly Report. Chief
Cockrill gave the council statics for May, 2019 and said they are starting on the
next round of street light monitoring. He also said they had begun their park
patrol and have officers at the parks from 4 pm to 10 pm each night.
B) ENGINEER'S REPORT
City Engineer Damon Johnson addressed the council with his monthly report. He
said they are almost ready to go out for bids on the Contract Section III. They
are changing media filters at the Water Treatment Plant. This is done every 5 to
7 years. The Street Department is working on their normal projects such as
roads, drainage, patching pot holes, etc. He said the stoplight at 20th and
Harrison was out last week but has been corrected. We are still waiting on the
one arm sanitation truck, however, the satiation department has been placing
yellow tags on cans that need to make some kind of an adjustment to their cans
before the one arm truck arrives. Mr. Johnson said some people have
misrepresented the meaning of the tags. He said the tags are only for guidance
to help the citizens know how their cans need to be places.
C) CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO APPLY FOR
AN OUTDOOR RECREATIONS MATCHING GRANT FROM THE ARKANSAS
DEPARTMENT OF PARKS AND TOURISM
Councilmember Matthews introduced a resolution authorizing the Mayor to apply
for an outdoor recreation matching grant from the Arkansas Department of Parks
and Tourism. Councilmember Hubbard moved to read the resolution by title
only. Councilmember Poole seconded and the electronic roll call count was 7 for
and 0 against. Mr. Meitzen read the resolution by title only. Councilmember
Hinkle moved to adopt the resolution and Councilmember Fredricks seconded.
The electronic roll call count was 7 for and 0 against. The resolution was given
#2019-06-01-R.
D) CONSIDER AN ORDINANCE FOR THE APPROVAL OF AN APPLICATION
FOR A PRIVATE CLUB PERMIT
Councilmember Matthews introduced an ordinance for the approval of an
application for a private club permit. Mr. H. T. Moore, Attorney for the applicant,
addressed the council to answer any questions. Mr. Moore said Mr. Burim
"Bruno" Azemi with Tavolo Italian Ristorante is requesting the permit for his
business. Mr. Moore said Mr. Azemi also has a restaurant in Paragould where
Mr. Moore resides and stated that Mr. Azemi and his restaurant were an asset to
the City of Paragould. He also reminded the council that Mr. Azemi has to get
approval from the city council before he is able to make an application to the
State for final approval. Councilmember Hinkle moved to suspend the rules and
read the ordinance by title only. Councilmember Fredricks seconded and the
electronic roll call count was 7 for and 0 against. Mr. Meitzen read the ordinance
by title only. Councilmember Fredricks moved to further suspend the rules and
waive the second and third readings. Councilmember Hubbard seconded and
the electronic roll count was 7 for and 0 against. Councilmember Hinkle moved
to adopt the ordinance and Councilmember Fredricks seconded and the
electronic roll call count was 7 for and 0 against. The ordinance was given
#2019-06-01. Mr. Meitzen read the emergency clause. Councilmember Hinkle
moved to adopt the emergency clause. Councilmember Fredricks seconded and
the electronic roll call count was 7 for and 0 against.
E) CONSIDER AN ORDINANCE TO AMEND THE BATESVILLE ZONING
DISTRICTS MAP TO ALLOW MULTIPLE SINGLE-FAMILY HOUSES ON A
SINGLE SPECIFIC LOT.
Councilmember Poole introduced an ordinance to amend the Batesville Zoning
Districts Map to allow multiple single-family houses on a single specific lot. Code
Enforcement Officer Chad McClure addressed the council regarding the
ordinance. Mr. McClure said Mr. Joey Markowski, who was also present, is
asking for the rezoning to allow him to build 8 small, 429 sq. ft., individual houses
on the specific lot. Mr. McClure said after a public hearing and a few changes,
the Planning Commission approve the request. Mr. Markowski said instead of
building an apartment building, which the lot was already approved for, he
wanted to give renters the option of a small house with their own green space
instead of an apartment. After some discussion, Councilmember Fredricks
moved to suspend the rules and read the ordinance by title only. Councilmember
Hinkle seconded and the electronic roll call count was 7 for and 0 against. Mr.
Meitzen read the ordinance by title only. Councilmember Fredricks moved to
further suspend the rules and waive the second and third readings.

F) CONSIDER AN ORDINANCE ADOPTING THE CITY OF BATESVILLE
STORMWATER MANAGEMENT AND DRAINAGE MANUAL
Councilmember Matthews introduced an ordinance to adopt the City of Batesville
Stormwater Management and Drainage Manual. Councilmember Hinkle moved
to suspend the rules and read the ordinance by title only. Councilmember
Fredricks seconded and the electronic roll call count was 7 for and 0 against. Mr.
Meitzen read the ordinance by title only. Councilmember Fredricks moved to
further suspend the rules and waive the second and third readings.

G) CONSIDER AN ORDINANCE ADOPTING THE CITY OF BATESVILLE
STREET MASTER PLAN SPECIFICATIONS AND DETAILS
Councilmember Matthews introduced an ordinance to adopt the City of Batesville
Street Master Plan. Again Mr. Johnson said the street master plan has been in
the works for a long time and is needed primarily for new construction and
repairing existing streets. Councilmember Matthews moved to suspend the rules
and read the ordinance by title only. Councilmember Hubbard seconded and the
electronic roll call count was 7 for and 0 against. Mr. Meitzen read the ordinance
by title only. Councilmember Matthews moved to further suspend the rules and
waive the second and third readings. Councilmember Fredricks seconded and
the electronic roll count was 7 for and 0 against. Councilmember Matthews
moved to adopt the ordinance and Councilmember Hinkle seconded and the
electronic roll call count was 7 for and 0 against. The ordinance was given

H) CONSIDER AN ORDINANCE ADOPTING THE CITY OF BATESVILLE
STREETS AND DRAINAGE TECHNICAL SPECIFICATIONS AND DETAILS
Councilmember Matthews introduced an ordinance to adopt the City of Batesville
Streets and Drainage Technical Specifications. Councilmember Matthews
moved to suspend the rules and read the ordinance by title only. Councilmember
Fredricks seconded and the electronic roll call count was 7 for and 0 against. Mr.
Meitzen read the ordinance by title only. Councilmember Matthews moved to
further suspend the rules and waive the second and third readings.

1) CONSIDER AN ORDINANCE TO AMEND ORDINANCE 981 AND THE
BATESVILLE MUNICIPAL CODE CHAPTER 9.08, SECTIONS 9.08.01
Councilmember Matthews introduced an ordinance to amend ordinance #981
regarding the excavation of streets and sidewalks inside the city limits of
Batesville. Mr. Johnson said the amendment sets out specific guidelines on
obtaining a permit to excavate any sidewalk or street and specifications on the
repairs of the excavation. Councilmember Matthews moved to suspend the rules
and read the ordinance by title only. Councilmember Fredricks seconded and
the electronic roll call count was 7 for and 0 against. Mr. Meitzen read the
ordinance by title only. Councilmember Fredricks moved to further suspend the
rules and waive the second and third readings. Councilmember Hinkle seconded
and the electronic roll count was 7 for and 0 against. Councilmember Fredricks
moved to adopt the ordinance and Councilmember Hinkle seconded and the
electronic roll call count was 7 for and 0 against. The ordinance was given
#2019-06-06.
J) EXECUTIVE SESSION
Councilmember Matthews moved to go into executive sessions to consider the
promotion, demotion, hiring or firing of one or more city employees.
Councilmember Fredricks seconded and all voted for.
Councilmember Fredricks moved to appoint Mr. Pete Musgrave to fill the
unexpired term of Ronda Bryant on the Batesville City Council. Councilmember
Matthews seconded and all voted for. Mr. Musgrave's term will expire
12/31/2020.
Councilmember Fredricks moved to appoint Mr. Landon Reeves to the Planning
and Zoning Commission. Mr. Reeves will replace Ms. Carma Osborn and his
term will expire 6/10/2024.
MAYOR COMMENTS
City Clerk Denise Johnston asked the council to consider increasing the City and
Utilities recorded fixed asset amount from $2,500. To $5,000. The amount has not
been increased since 2010 and the request for $5,000.00 is a more reasonable amount.
Councilmember Matthews moved to increase the fixed asset amount. Councilmember
Krug seconded and all voted for.
Mayor Elumbaugh said he wants our community to know that he and others in the
community have met with the CEO's of PECO and Georges (formally OMP) regarding
the odors coming from both plants. The Mayor said both plants make a huge impact in
our community with their large number of employees, however, the quality of life for our
citizens has to be considered. He said the meeting was productive and both CEO's
pledged to invest in their wastewater systems to help with the offensive odors. The
Mayor did however say these changes will not take place overnight and asked the
citizens to be patient with the process.
LIAISON REPORTS

COUNCIL COMMENTS
Councilmember Matthews said he attended a breakout session at the Municipal League
regarding the upcoming 2020 Census. He mentioned the importance of the census
count and all the steps that lead up to the count. City Clerk Johnston said she also
attended the meeting and her office as well as Code Enforcement have already started
the process.
ADJOURNMENT
There being no further business, Councilmember Matthews moved that the
meeting be adjourned. Councilmember Fredricks seconded and all voted for.
