CITY OF BATESVILLE,ARKANSAS
A RESOLUTION AUTHORIZING THE MAYOR TO INITIATE CONDEMNATION
PROCEEDINGS FOR THE ACQUISITION OF EASEMENTS NEEDED FOR THE
CONSTRUCTION OF THE BATESVILLE GREENWAY AND FOR OTHER PUPOSES
WHEREAS, Batesville currently operates the Batesville Greenway trail system in order
to promote public health and recreation;
WHEREAS, Batesville has previously adopted a master plan for the expansion of the
Batesville Greenway; and
WHEREAS, while the City in good faith attempts to acqaire easements from property
owners without litigation, it is sometimes necessary to use the pt)wer of eminent do-main to
procure said easements.
NOW, THEREFORE,BE IT RESOLVED by the City Council of the City of Batesville,
Arkansas:
The Mayor of the City of Batesville is hereby authorized to use the power of eminent
domain as authorized under State and Federal law in order to procure easements and such
property interests necessary to complete the Batesville Greenway= per its master plan.
