AN ORDINANCE ORDINANCE REZONING CERTAIN PROPERTY FROM R-2 RESIDENTIAL
TO R-1 RESIDENTIAL REQUESTED BY CLINT AND MAYFAN THOMAS.
BE IT ORDAINED BY THE CITY COUNCIL OF BATESVILLE, ARKANSAS AS
FOLLOWS:
(1) The following property be and the same is hereby rezoned from R-2 Residential to R-
1 Residential; said property has been recommended for rezoning before the Batesville
Planning Commission at a published public hearing on Monday, February 5, 2007.
(2) That the property is described as thus:
All property that is zoned R-2 located South of Elm Street, East of North 10"'
Street, and North of Rock Street.
PASSED AND APPROVED THIS 27`h DAY OF FEBRUARY 2007.

RECOMMENDATIONS OF THE CITY PANNING COMMISSION
The City Planning Commission of the City of Batesville, Arkansas, held its regular
monthly meeting on Monday, February 5, 2007, with Chairman Carma Osborn presiding.
Also present were Secretary Brian Langston, and Commission members Steven Lewis,
Tommy Bryant, Ronnie Hampton and Nina Womack. Comm. Fagan was absent. Also
present was Code Enforcement Officer Chad McClure, Mayor Rick Elumbaugh, City
Council Members Stephen Smart and Dr. Douglas Matthews.
A public hearing was held with reference to the petition filed by Clint & Mayfan Thomas
asking for the rezoning of the following described property, to wit:
Property located south of Elm St., north of Rock St. and east of 10`x' St. All Property
being located in the School Addition. This small parcel, not even comprising a full lot,
has never been given a legal description on the city map. It is owned by the Batesville
School District and is presently included as a part of the Batesville Middle School
property.
The petition sought the rezoning of the above-described property from residential R-2 to
residential R-1.
• Commissioner Bryant moved that the Commission recommend to the City Council of the
City of Batesville, Arkansas, the rezoning of the above-described property from
residential R-2 to Residential R-1 and that the application for rezoning be approved. The
motion was seconded by Commissioner Hampton and upon a vote of the Commission
was passed unanimously other than Commissioner Fagan who was absent from voting.
The City Planning Commission of the City of Batesville, Arkansas, recommends to the
City Council of the City of Batesville, Arkansas, that the petition as filed be granted and
that appropriate action be taken by the City Council to carry out the recommendations of
the City Planning Commission.
