AN ORDINANCE TO AMEND THE BATESVILLE ZONING DISTRICTS MAP; AND FOR
OTHER PURPOSES.
WHEREAS,the Batesville,Arkansas Comprehensive Plan encourages the development of a
variety of housing choices;and,
WHEREAS, an application has been submitted to the Batesville Planning Commission to
consider the development of multiple single-family housing on a single lot as a Planned Development
Zone;and,
WHEREAS, the Batesville Planning Commission held a properly advertised public hearing on
the requested amendment to the Zoning Districts Map on June 3,2019 and has recommended that the
Batesville City Council approve the requested zoning amendment as being consistent with the
Comprehensive Plan and with the eligibility requirements of the Batesville Zoning Code.
NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
BATESVILLE,ARKANSAS THAT THE BATESVILLE ZONING DISTRICTS MAP IS
HEREBY AMENDED AS FOLLOWS:
Section 1. The property to be zoned as a Planned Development(PD)District is defined as follows:
Tract 1: Part of the Southwest Quarter of the Southeast Quarter of Section 08,Township 13
North,Range 06 West,Independence County,Arkansas and more particularly described as
follows:Commencing at the Northwest corner of the Northwest Quarter of the Southeast Quarter
of Section 08, Township 13 North,Range 06 West, Independence County,Arkansas;thence S
01°46'54" W a distance of 1,543.00 to a set railroad spike at the Point of Beginning,thence S
88048'08" E a distance of 158.88 feet to a set 1/2-inch iron reinforcement bar with an
identification cap,thence S 00055'08" E a distance of 68.04 feet to a point,thence N 89°43'09" W
a distance of 7.91 feet to a set 1/2-inch iron reinforcement bar with an identification cap,thence S
00°13'11" W a distance of 34.89 feet to a set 1/2-inch iron reinforcement bar with an
identification cap,thence N 88°30'58" W a distance of 155.59 feet to a set 1/2-inch iron
reinforcement bar with an identification cap,thence N 02°02'42" E along the East right of way
line of North Heights Street a distance of 102.24 feet to the point of beginning,containing 0.37
acres more or less and is subject to easements and rights of way of record,prescriptive and
permissive.
Tract 2: Part of the Southwest Quarter of the Southeast Quarter of Section 08,Township 13
North,Range 06 West, Independence County,Arkansas and more particularly described as
follows: Commencing at the Northwest corner of the Northwest Quarter of the Southeast Quarter
of Section 08, Township 13 North,Range 06 West, Independence County,Arkansas;thence S
001 46'54" W a distance of 1,543.00 to a set railroad spike,thence S 02002'42" W along the East
right of way line of North Heights Street a distance of 102.24 feet to a set 1/2-inch iron
reinforcement bar with an identification cap,thence continue S 02°02'42" W along the East right
of way line of North Heights Street a distance ofl07.15 feet to a set 1/2-inch iron reinforcement
bar with an identification cap,thence S 89°43'09" E along the North right of way line of East
Morrow Street a distance of 158.96 feet to a set 1/2-inch iron reinforcement bar
with an identification cap at the Point of Beginning;thence N 00°13'11"E a distance of 138.72
feet to a set 1/2-inch iron reinforcement bar with an identification cap,thence S 89°43'09"E a
distance of 70.91 feet to a set 1/2-inch iron reinforcement bar with an identification cap,thence S
00°59'39" W a distance of 138.73 feet to a set 1/2-inch iron reinforcement bar with an
identification cap,thence N 89°43'09" W along the North right of way line of East Morrow
Street,a distance of 69.04 feet to the point of beginning;and,
containing 0.22 acres more or less and is subject to easements and rights of way of record,
prescriptive and permissive to the point of beginning.
Section 2. The permitted use on the above referenced property is limited to eight(8)single family
residences, none of which shall exceed four hundred and thirty(430)square feet in size;and,
Section 3. The above referenced property shall be developed in accordance with the Site Plan attached
hereto as Exhibit A.No deviation is permitted.Failure to develop said property in strict
accordance with said Site Plan shall nullify the Planned Development District classification and
the zoning shall revert back to its original zoning.
IF ANY PORTION OR PORTIONS OF THIS ORDINANCE ARE DEEMED OR HELD
TO BE INVALID,SUCH INVALIDITY SHALL NOT AFFECT THE REMAINING PORTION
OR PORTIONS OF THIS ORDINANCE.
EMERGENCY CLAUSE: Where as it is necessary to affect the public peace,health,safety and
welfare and the orderly administration of Batesville City Codes,an emergency is hereby declared to exist
and this Ordinance shall be effective from and its passage.
