HomeMy WebLinkAbout2019-11-02 ORDINANCE NO�i -11-oa AN ORDINANCE TO AMEND THE BATESVILLE ZONING DISTRICTS MAP; AND FOR OTHER PURPOSES. WHEREAS, King TEJ Leasing LLC has requested that certain property, described below, be re- zoned so as to align the zoning classification with the proposed use of said property and be consistent with the Comprehensive Plan; and WHEREAS, the Batesville Planning Commission has conducted a properly advertised public hearing on November 4, 2019; and, WHEREAS, the Batesville Planning Commission, at its regularly scheduled meeting on November 4,2019, has reviewed the relationship of this property with the Comprehensive Plan and determined that proposed use would be consistent with said Plan; and, WHEREAS,the Batesville Planning Commission has recommended that the requested amendment to the Zoning Districts map be approved by the City Council. NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BATESVILLE, ARKANSAS THAT THE BATESVILLE ZONING DISTRICTS MAP IS HEREBY AMENDED AS FOLLOWS: From Community Commercial (C-1)to Traditional Business District(T-1) A part of Block 37 of Egner's Addition to the City of Batesville,Arkansas, described thus: Commencing at the Northeast corner of said Block 37 at the point of intersection of the South line of Boswell Street and the West line of Third Street,thence Southeasterly along the West line of Third Street 180 feet to the point of beginning; thence westerly and parallel with Boswell Street 75 feet; thence Northerly and parallel with Third Street 180 feet to a point on the South line of Boswell Street; thence Westerly along the South line of Boswell Street 65 feet to a point;thence Southerly and parallel with Third Street 180 feet; thence Westerly and parallel with Boswell Street 60 feet; thence Southerly and parallel with Broad Street 32 1/2 feet;thence Easterly and parallel with Boswell Street 156 feet to a point on the West line of River Street;thence Northerly along the West line of River Street and Third Street to the point of beginning. LESS AND EXCEPT: A part of Block 37 of Egner's Addition to the City of Batesville, Arkansas, described thus: Commence at the NE corner of said Block 37 at the point of intersection of the South line of Boswell Street with the West line of Third Street and run thence Southeasterly along West line of Third Street a distance of 180 feet to a point(being the SE corner of the Sheffield Tract);thence in a Westerly direction along the South line of the Sheffield'Tract 75 feet to a point;thence in a Northerly direction and parallel with Third Street along the West line of the Sheffield Tract a distance of 180 feet to a point on the South line of Boswell Street; thence Westerly and along the South line of Boswell Street a distance of 65 feet to a point(being the NE corner of what was formerly known as the Julia Rowlett tract);thence in a Southerly direction and along East line of the Rowlett tract a distance of 180 feet to the Point of Beginning;thence in a Westerly direction and along the South line of the Rowlett Tract a distance of 60 feet to a point; thence in a Southerly direction and parallel with Broad Street a distance of 32-1/2 feet to a point;thence in an Easterly direction and parallel with Boswell Street a distance of 60 feet;thence in a Northerly direction 32-1/2 feet to the Point of Beginning. IF ANY PORTION OR PORTIONS OF THIS ORDINANCE ARE DEEMED OR HELD TO BE INVALID, SUCH INVALIDITY SHALL NOT AFFECT THE REMAINING PORTION OR PORTIONS OF THIS ORDINANCE. IT IS SO ORDAINED.
