HomeMy WebLinkAbout2007-03-01 ® ORDINANCE NO. 2007-3-1 AN ORDINANCE REPEALING ORDINANCE NO. 801 OF 1971 AS AMENDED BY ORDINANCE NO. 97-10-1 OF 1997 OF THE CITY OF BATESVILLE, ARKANSAS AND DECLARING AN EMERGENCY WHEREAS, pursuant to the laws of the State of Arkansas, the City of Batesville, by Ordinance No. 801 of 1971, created the Batesville Water Utility (the "Commission") to operate the city owned water and sewer department; and WHEREAS, by Ordinance No. 97-10-1 of 1997, Ordinance No. 801 was amended in regards to the membership, terms and board of the Utility Commission; and WHEREAS, the City is now desirous of restoring to the Mayor and City Council of the City of Batesville the responsibility of operating the city owned water works, water distribution system and sewer system; and WHEREAS, Ordinance No. 801 of 1971 as amended by Ordinance No. 97-10-1 of 1997 is in conflict therewith. NOW, THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BATESVILLE, ARKANSAS Section 1. That Ordinance No. 801 of 1971 as amended by Ordinance No. 97-10-1 of 1997 which created the Commission be and hereby is repealed in its entirety effective upon passage of this ordinance. Section 2. That all other ordinances or parts of ordinances in conflict herewith are hereby repealed. Section 3. That the manager/supervisor of the Batesville Water Works/Batesville Water and Sewer Department shall report to, and be under the direct supervisory authority of the Mayor as a department head. Section 4. The current employees of the Batesville Water Works/Batesville Water and Sewer Department are grandfathered in as employees of the City of Batesville for purposes of complying with the nepotism rules of the City of Batesville. Any future employees of Batesville Water Works/Batesville Water and Sewer Department will have to comply with the nepotism rules applicable to all city employees. Section 5. The City Council recognizes the urgent need to provide continuous water and sewer services to the residents of the City of Batesville. Therefore, an emergency is declared to exist and this ordinance, being ® necessary for the preservation and advancement of the public peace, health and safety, shall be in full force and effect from and after its passage.
