AN ORDINANCE TO UPDATE THE BATESVILLE MASTER STREET PLAN; TO REPLACE
AN EARLIER ADOPTED ORDINANCE IN ORDER TO MEET THE REQUIREMENTS OF
STATE STATUTE; TO PROVIDE UNIFORM STANDARDS FOR STREET DESIGN AND
CONSTRUCTION; AND FOR OTHER PURPOSES.
WHEREAS,there has been substantial growth in and around the City of Batesville since the last
adoption of a Master Street Plan; and,
WHEREAS,the lack of standards to provide the basic framework to support the developmep_t of
Batesville and its Planning Area and provide the basis for enforccm-ent of the Batesville Subdivision.
Regulations;and,
WHEREAS, it is essential to provide comprehensive standards to promote quality construction
and;
WHEREAS,the Batesville Planning Commission has reviewed the Street Master Plan prepared by
Crafton Tull,and conducted a properly advertised public hearing as required by law on December 9,
2019; and,
WHEREAS, Ordinance 2019-06-04, adopted on 18 June 2019,was not preceded by a public
hearing and Planning Commission review as required by law; and,
WHEREAS,the Batesville Planning Commission,at its called meeting on December 9,2019,
recommended,by unanimous vote,that said Plan be adopted by ordinance by the Batesville City Council;
NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
BATESVILLE,ARKANSAS:
Section 1. Ordinance 2019-06-04,adopted on 18 June 2019, is hereby repealed.
Section 2. The City of Batesville Street Master Plan recommended by the Batesville Planning
Commission is hereby adopted.
IF ANY PORTION OR PORTIONS OF THIS ORDINANCE ARE DEEMED OR HELD TO
BE INVALID,SUCH INVALIDITY SHALL NOT AFFECT THE REMAINING PORTION OR
PORTIONS OF THIS ORDINANCE.
IT IS SO ORDAINED.
