AN ORDINANCE TO AMEND THE BATESVILLE ZONING DISTRICTS MAP; AND FOR OTHER
PURPOSES.
WHEREAS, an application was submitted to the Batesville Planning Commission for the purpose of
requesting an amendment to the Zoning Districts Map for the below referenced property;and,
WHEREAS, the Batesville Planning Commission has conducted a properly advertised public hearing on
March 5,2018;and,
WHEREAS, the Batesville Planning Commission has reviewed the relationship of this property with the
Comprehensive Plan;and,
WHEREAS, the Batesville Planning Commission has recommended that the requested amendment to the
Zoning Districts map be approved by the City Council.
NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
BATESVILLE, ARKANSAS THAT THE BATESVILLE ZONING DISTRICTS MAP IS HEREBY
AMENDED AS FOLLOWS:
From Single Family Residential(R-1)to Commercial Community(C-1);
All that part of the following tract of land being part of Section 15,Township 13 North,Range 6 West,in the
City of Batesville,Independence County,Arkansas,not already classified as Community Commercial(C-1),
more particularly described as follows:Commencing at the southeast corner of the E 1/2 of the SW 1/4 of
Section 15,T13N,R6W,thence run North 00 degrees 52 minutes 36 seconds East along the east line of said
E 1/2 SW 1/4 a distance of 1,266 feet;thence run North 88 degrees 31 minutes 48 seconds West a distance of
374.07 feet to the Point of Beginning;thence run North 88 degrees 31 minutes 48 seconds West a distance of
534.00 feet;thence run North 23 degrees 14 minutes 03 seconds East a distance of 50.00 feet; thence run
® North 75 degrees 26 minutes 06 seconds a distance of 111.88 feet;thence run North 25 degrees 25 minutes 50
seconds East a distance of 795.73 feet;thence run North 01 degrees 59 minutes 1 I seconds East a distance of
449.36 feet to the westerly right-of-way line of Harrison Street(Arkansas Highway 69);thence run along the
westerly right-of-way line as follows: South 55 degrees 23 minutes 07 seconds East 98.48 feet;South 44
degrees 47 minutes 00 seconds East 101.72 feet; South 29 degrees 26 minutes 50 seconds East 130.54 feet;
South 15 degrees 07 minutes 53 seconds East 327.21 feet;South 45 degrees 52 minutes 53 seconds East 8.55
feet;thence leaving said westerly right-of-way line,run South 00 degrees 31 minutes 17 seconds West a
distance of 173.55 feet;thence run North 88 degrees 32 minutes 48 seconds West a distance of 255.00 feet;
thence run South 00 degrees 22 minutes 15 seconds West a distance of 525.00 feet to the Point of Beginning.
IF ANY PORTION OR PORTIONS OF THIS ORDINANCE ARE DEEMED OR HELD TO BE
INVALID,SUCH INVALIDITY SHALL NOT EFFECT THE REMAINING PORTION OR PORTIONS OF
THIS ORDINANCE.
