HomeMy WebLinkAbout2018-06-01 ORDINANCE NOC o/ ?—0(0-01 AN ORDINANCE TO AMEND VARIOUS PROVISIONS OF THE BATESVILLE ZONING CODE; AND FOR OTHER PURPOSES. WHEREAS,the Batesville Planning Commission became aware of the possibility and desirability of locating a Children's Advocacy Center somewhere in the City; and, WHEREAS,the Batesville Planning Commission concluded that revisions to the code were necessary and appropriate to explicitly allow a facility to help children heal from abuse while holding offenders accountable; and, WHEREAS,the Batesville Planning Commission, after conducting a public hearing on June 18, 2018, has voted at its called meeting on June 18,2018,to recommend that certain items in Title 14 of the Batesville Municipal Code be revised to allow, either by right or conditionally, such a facility; and, WHEREAS,the Batesville City Council concurs in the recommendation of the Planning Commission and agrees that the location of a Children's Advocacy Center in Batesville would highly advantageous in promoting the health, safety and welfare of children. NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BATESVILLE,ARKANSAS THAT CHAPTER 14.02 OF THE BATESVILLE ZONING CODE IS HEREBY AMENDED AS FOLLOWS: Section 1. Definition. The following new definition is added to Section 14.02.02 of the Batesville Zoning Code,between Child Care Facility and Church,to read as follows: "Children's Advocacy Center. A child focused, community-based facility that coordinates the investigation,prosecution and treatment of child abuse while reducing the trauma to child victims of physical abuse, sexual abuse, or neglect. Consistent with the requirements of Arkansas law,at ACA 20-78-105,as amended, such facilities emphasize the coordination of investigation and intervention services by collaboration among medical,mental health, prosecutorial,child protective and law enforcement professionals and agencies to create a child-focused approach to child abuse cases in a way that creates a sense of safety and security for the children. The facility may only operate as a non-residential use,but preferably in a residential or semi-residential environment. Only a tax- exempt 501(c)(3)non-profit organization that complies with the requirements of Arkansas law,as cited above,and is accredited,or actively seeking accreditation,through the National Children's Alliance,and is a member of the Children's Advocacy Centers of Arkansas will be considered to meet the requirements of this definition. Section 2. Child Advocacy Center permitted by right in the Historic Residential District(HR) Section 14.06.02.A. is amended by adding the following: "13. Child Advocacy Center" Section 3. Child Advocacy Center is permitted conditionally in other zoning districts as follows: In Single Family Residential(R-1)at 14.06.0l.B: Add "4. Children's Advocacy Center" In General Family Residential(R-2)at 14.06.03.B: Add "10. Children's Advocacy Center" In Traditional Business District(T-1)at 14.07.0l.B: Add "6. Children's Advocacy Center" In Commercial Community District(C-1)at 14.07.02.B: Add "5.Children's Advocacy Center" IF ANY PORTION OR PORTIONS OF THIS ORDINANCE ARE DEEMED OR HELD TO BE INVALID,SUCH INVALIDITY SHALL NOT AFFECT THE REMAINING PORTION OR PORTIONS OF THIS ORDINANCE. EMERGENCY CLAUSE: Whereas it is necessary to affect the public peace,health, safety and welfare of abused children,an emergency is hereby declared to exist and this Ordinance shall be in full force and effect from the date of its passage.
