AN ORDINANCE TO WAIVE COMPETITIVE BIDDING FOR THE REPAIR AND REMODEL OF
THE BATESVILLE POLICE DEPARTMENT; AND FOR OTHER PURPOSES
WHEREAS, the City recently purchased a building to house the Batesville Police Department;
WHEREAS, that said building is in need of repair and renovation, including making said
building compliant with the American's With Disabilities Act;
WHEREAS, that the Police Department's need of the renovated facility is immediate;
WHEREAS, that M & A Construction Co., Inc. is a local construction company who is available
to begin work immediately and was the original builder of this property which gives it the intimate
knowledge necessary for the remodel and repair to proceed quickly and efficiently; and
WHEREAS, Arkansas Code Annotated § 14-58-303 allows this governing body by ordinance to
waive the requirements of competitive bidding in exceptional situations;
NOW, THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF BATESVILLE,
ARKANSAS:
Section 1: There are exceptional circumstances whereby the requirements of competitive are
neither practical nor feasible and the City Council, therefore, waives the requirements of competitive
bidding for the repair and remodel of the building located 51 Industrial Drive which is to be used as
the headquarters of the Batesville Police Department.
Section 2 - Severability Provision: If any part of this ordinance is held invalid, the
remainder of this Ordinance shall continue in effect as if such invalid portion never existed.
Section 3 — Repeal of Conflicting Provisions: All ordinances, resolutions or orders of the
City Council, or parts of the same, in conflict with this Ordinance are repealed to the extent of such
conflict.
EMERGENCY CLAUSE: It is hereby found by the City Council that the Batesville Police
Department's need of a new facility is immediate, therefore an emergency is declared to exist, and
this ordinance being necessary for the preservation and advancement of public peace, health,
finances and safety, shall be in full force and effect from and after the date of its approval.
