AN ORDINANCE TO AMEND THE BATESVILLE ZONING CODE.
WHEREAS, The Batesville Zoning Code currently allows apartments in
the T-1 Traditional Business District through the use of conditional use permits,
and
WHEREAS, said conditional use permits do not allow apartments to be
permitted on the ground floor of any structure except for entry or exit, and
WHEREAS, to further the re-vitalization of the T-1 Traditional Business
District in the downtown area, and
WHEREAS, it is determined that the city's best interests will be served by
encouraging creative utilization of space in the T-1 Traditional Business District.
NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF
BATESVILLE, ARKANSAS THAT THE BATESVILLE ZONING CODE IS
HEREBY AMENDED AS FOLLOWS:
SECTION 1. Section VIII, COMMERCIAL DISTRICTS;
I. T-1 Traditional Business District
B. Conditional Uses
currently reads:
The following may be allowed by conditional Use Permit in accordance
with the provisions of Section XIII:
1 . Apartments, when the Commission finds they do not use ground
floor space, except for entry or exit, and do not interfere with the commercial
nature of the neighborhood and do provide adequate parking.
SECTION 2. This section is hereby amended to read as follows:
The following may be allowed by conditional Use Permit in accordance
with the provisions of Section XIII:
1. Apartments, when the Commission finds they do not use any part
Oof the front portion of the ground floor space, and do not interfere with the
commercial nature of the neighborhood and do provide adequate parking.
