A01, —0q—of AN ORDINANCE TO WAIVE COMPETITIVE BIDDING AND AUTHORIZE THE CITY OF BATESVILLE TO ACCEPT THE BID FROM WORLD WATER WORKS FOR THE CONSTRUCTION OF ADDITIONAL WALKWAYS ON THE DISSOLVED AIR FLOTATION UNITS AT THE WASTEWATER PLANT WHEREAS, the wastewater plant has two World Water Works dissolved air flotation units (herein after also referred to as after "DAFs"), WHEREAS, that the DAFs are currently accessible by steep "ship's ladders" with minimal walkways. WHEREAS, that the current walkway and ladder system does not allow access to all of the moving parts of the DAFs and the ladders are not safe for repeated daily access, WHEREAS, that it is necessary to use World Water Works on this bid exclusively because they are the manufacturers of the DAFs which are made of welded polyethylene materials which they alone have the expertise to attach the new walkways without compromising the structural integrity of the DAFs, WHEREAS, that this project will allow staff to have full and safe access to the units, WHEREAS, Arkansas Code Annotated § 14-58-303 allows this governing body by ordinance to waive the requirements of competitive bidding in exceptional situations where bidding is deemed not feasible or practical; NOW, THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF BATESVILLE, ARKANSAS: Section 1. That Batesville City Wastewater Plant has immediate need of new stairs and additional walkways to safely access its two dissolved air flotation units. Section 2. That because only World Water Works can provide stairs and walkways that are compatible with the dissolved air flotation units, and because the need is immediate due to the lack of access and danger of said access, competitive bidding is deemed to not be feasible or practical and is hereby waived. Section 3. That Batesville Wastewater Plant is hereby authorized to accept the bid for the construction of new stairs and walkways to access the dissolved air flotation units from World Water Works for the approximate sum Clean Water and Energy from Wastewater DATE: September 8, 2017 TO: Eugene Townsley,City of Batesville FROM: Kyle Booth, World Water Works, Inc. The walkways will mate up to the existing installed walkways and run down the outside of each of the DAF units. The Additional part will attached between walkway and the existing structure. Scope of Work: World Water Works will supply the walkways with handrails on both sides, small step from existing platforms to the new one. WWW will supply the necessary brackets and hardware to mount the walkway to the existing DAF units. New supports will be included to weld on to the DAF. The welding of the supports on site and assembly of the walkway is estimated for(3) WWW personnel, a total of(3) days' onsite. Two additional days are required for travel to and from the jobsite. We have not included the rental of any equipment to lift and place the walkways. If rental is needed, it will be billed separately. Man hours are assumed as weekday hours. Delivery: Submittals 2 weeks, Please allow (8) eight weeks for walkway construction after submittal approval. Once the materials have been received on the site, WWW estimates 1 week of installation. Below is the WWW standard rate sheet. This will apply to any time and/or materials not listed above. EMERGENCY CLAUSE: It is hereby found by the City Council that due to the current lack of accessibility to the dissolved air flotation units and the danger of the current stairs, the City's need is immediate, therefore, an emergency is declared to exist, and this ordinance being necessary for the preservation and advancement of public peace, health, finances and safety, shall be in full force and effect from and after the date of its approval.
