CITY OF BATESVILLE, ARKANSAS
A RESOLUTION CONDEMNING A FIRE-DAMAGED STRUCTURE
LOCATED ON REAL PROPERTY IN THE CITY OF BATESVILLE
WHEREAS, the home located at 990 College Street in the City of Batesville
owned by Danny and Tammy Cox was damaged by fire on November 11, 2011;
WHEREAS, as a result of the fire, the home suffered damage including, but
not limited to: major structural components missing such as roof, walls, windows
and doors;
WHEREAS, the structure has remained vacant and unattended since the time
of the fire or shortly thereafter;
WHEREAS, due to ongoing litigation between the homeowner and a third
party, no attempts have been made to repair the structure and none are ongoing at
this time; and
WHEREAS, the homeowners have been notified at least twenty (20) days
prior to the Council hearing, and the City of Batesville is in compliance with all
requirements set forth in Batesville Municipal Code Chapter 11.12.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL
OF THE CITY OF BATESVILLE, ARKANSAS:
THAT, the structure located at 990 College Street is hereby condemned as a
nuisance, and a true and correct copy of this Resolution will be provided to Danny
and Tammy Cox by mailing the same to their last known address, as well as
notifying their attorney, and a copy shall be posted in a conspicuous place on the
condemned property. If the nuisance has not been abated within thirty (30) days
after posting this Resolution at the property, the structure will be torn down by the
City of Batesville.
