AN ORDINANCE TO AMEND THE BATESVILLE ZONING DISTRICTS MAP;
AND FOR OTHER PURPOSES.
WHEREAS, Paula Terrell has requested that certain property, described as the
attached exhibits, located between 3096 Harrison Street and 3245 Juniper be rezoned so
as to change from R-1 Residential to R-2 Residential; and
WHEREAS, the Batesville Planning Commission has prepared recommendations
to assign permanent zoning district classifications to said properties, and conducted a
properly advertised public hearing on 8/2/21 and,
WHEREAS, the Batesville Planning Commission, at its regularly scheduled
meeting on 8/02121, has reviewed the relationship of this property with the
Comprehensive Plan and determined that the proposed use would be consistent with said
Plan: and,
WHEREAS, the Batesville Planning Commission has recommended that the
requested amendment to the Zoning District map be approved by the City Council.
NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF BATESVILLE, ARKANSDAS THAT THE BATESVILLE
ZONING DISTRICTS MAP IS HEREBY AMENDED AS FOLLOWS:
Section 1: That the following described Real Property in the City of Batesville,
Arkansas is hereby rezoned from R-1 Residential to R-2 Residential:
Legal description is attached hereto as Exhibit "A" and incorporated
herein by reference.
Section 2: That all ordinances and parts thereof in conflict herewith are hereby
repealed to the extent of such conflict.
Section 3: If any portion or portions of this ordinance are deemed or held to be
invalid, such invalidity shall not affect the remaining portions of this
ordinance.
IT IS SO ORDAINED.

EXHIBIT "A"
A tract of land being a part of the SE%4of the SEI/4 in
Section 15, Township 13 North, Range 6 West in the City
of Batesville, Independence County, Arkansas, more
particularly described as follows:
Commencing at the Southeast corner of said Section 15;
thence North 8801210111 West along the South line of said
Section 15, 675.74 feet to an existing pipe and the point of
beginning; thence continue North 88112'01" West,
318.70 feet to an existing rebar; thence North 03'18'51"
East, leaving said South line, 305.01 feet; thence South
88112'18" East, 311.49 feet; thence South 02'28'00"
West, 304.95 feet to the point of beginning. This tract
contains 2.20 acres, more or less, and is subject to any
and all easements.
ROAD EASEMENT DESCRIPTION:
A tract of land being a part of the SE `/. SE !:4 in Section
15, Township 13 North, Range 6 West in the City of
Batesville, Independence County, Arkansas, more
particularly described as follows:
Commencing at the Southeast corner of said Section 15;
thence North 88°12'01" West along the South line of said
Section 15, 675.74 feet; thence North 02'28'00" East,
304.95 feet; thence North 88"12'18" West, 273.52 feet to
the point of beginning: thence North 88'12'18" West,
25.02 feet; thence North 04103'40" East, 636.51 feet to
the nominal South right of way line of Harrison Street;
thence South 79'25'43" East, along said South right of
way line, 25.16 feet; thence South 04103'40" West leaving
said right of way line, 632.66 feet to the point of
beginning.
Subject to an easement agreement between Arnold/
Henry and Ryan's Family Steakhouse as shown in Book
F-16, Pages 227-232 of the Independence County
records.
