AN ORDINANCE TO AMEND THE BATESVILLE ZONING DISTRICTS MAP;
AND FOR OTHER PURPOSES.
WHEREAS, Jeremy Hart has requested that certain property, described as the
attached two exhibits, located at 405 White Drive be rezoned so as to change from R- I
Residential to C-1 Commercial; and
WHEREAS, the Batesville Planning Commission has prepared recommendations
to assign permanent zoning district classifications to said properties, and conducted a
properly advertised public hearing on 8/2/21 and,
WHEREAS, the Batesville Planning Commission, at its regularly scheduled
meeting on 8/02/2 1, has reviewed the relationship of this property with the
Comprehensive Plan and determined that the proposed use would be consistent with said
Plan; and,
WHEREAS, the Batesville Planning Commission has recommended that the
requested amendment to the Zoning District map be approved by the City Council.
NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF BATESVILLE, ARKANSDAS THAT THE BATESVILLE
ZONING DISTRICTS MAP IS HEREBY AMENDED AS FOLLOWS:
From R-1 Residential to C-1 Commercial
IF ANY PORTION OR PORTIONS OF THIS ORDINANCE ARE DEEMED OR HELD
TO HE INVALID, SUCH INVALIDITY SHALL NOT EFFECT THE REMAINING PORTION OR
PORTIONS OF THIS ORDINANCE.
IT IS SO ORDAINED.
