HomeMy WebLinkAbout2021-10-02ORDINANCE NO. D /— /O `'T AN ORDINANCE REDISTRICTING WARDS FOR THE CITY OF BATESVILLE, ARKANSAS, DECLARING AN EMERGENCY, AND FOR OTHER PURPOSES. WHEREAS, the City of Batesville has the authority to redistrict the Wards within the City upon a determination that the people can best be served by changing Ward boundaries to equalize the population in the various wards pursuant to Ark. Code Ann. Section 14-43-311; and, WHEREAS, the United States Census Bureau conducted the ten year Census of the United States in 2020; and, WHEREAS, the City Council has determined that the new 2020 Census information has created the need to redistrict the Wards to equalize the population of the Wards. NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF BATESVILLE ARKANSAS, THAT: Section 1: That the four (4) wards within the City of Batesville are hereby modified with the boundary lines as set forth below. WARD 1: Ward 1 shall be comprised of all that land within the City of Batesville described as follows: The area enclosed by a line beginning at the centerline intersection of S. St. Louis St. and Byers St., then, Run east along Byers St to its centerline intersection with the centerline of 17th St., then, Run north along 17th St. to its centerline intersection with the centerline intersection of Lyon St., then, Run east along Lyon St to its centerline intersection with the centerline of 19th St., then, Run north along 19th St. to its centerline intersection with the centerline of Porter St., then Run east along Porter St. to its centerline intersection with the centerline of 20th St., then, Run south along 20th St. to its centerline intersection with the centerline of Byers St., then, Run east along Byers St. to its centerline intersection with the centerline of 26th St., then, Run south along 26th St. to its centerline intersection with the centerline of Tanglewood St., then, Run west along Tanglewood St. to its centerline intersection with the centerline of Harrison St., then, Run east along Harrison St. to its centerline intersection with the Batesville city limits, then, Run along the city limits in a generally southerly, then westerly, then northerly, then southerly , then northerly direction to intersection of said city limits with the north shore of the White River, then, Run in a westerly direction along said north shore to its intersection with the centerline of S. St. Louis St., then, Run north along S. St. Louis St. Louis St. to its centerline intersection with Byers St., the point of beginning. WARD 2: Ward 2 shall be comprised of all that land within the City of Batesville described as follows: The area enclosed by a line beginning at the centerline intersection of S. St. Louis St. and Byers St., then, Run east along Byers St to its centerline intersection with the centerline of 17th St., then, Run north along 17th St. to its centerline intersection with the centerline of Lyon St., then, Run east along Lyon St to its centerline intersection with the centerline of 19th St., then, Run north along 19th St. to its centerline intersection with the centerline of E. College Ave., then, Run east along E. College Ave. to its centerline intersection with the centerline of Gwyn St., then, Run north along Gwyn St. to its centerline intersection with the centerline of Bearette St., then, Run east along Bearette St. centerline to the mid -point of a curve running to the south, then, Run due north along a line to its intersection with the Batesville city limits, then Run in a generally westerly, then northerly direction along said city limits line to its intersection with the centerline of E. Main St., then, Run in a generally westerly, then northerly, then easterly direction to its intersection with the centerline of E. Main St., then, Run in a northerly direction along E. Main St. to its intersection with the Batesville city limits, then, Run in a westerly, then southerly direction along the Batesville city limits to its intersection with Poke Bayou and the east line of Section 8, Range 6 West, Township 13 North, then, Run in a southerly direction to the intersection of Poke Bayou with the centerline of N. Broad St., then Run in a northerly direction along N. Broad St. to its intersection with the centerline of W. Carter St., then, Run in a westerly direction along W. Carter St. to its intersection with the centerline of N. State St., then, Run in a northerly direction along N. State St. to its intersection with the centerline of W. Pine St., then, Run in a westerly direction along W. Pine St. to its intersection with the centerline of Elsie St., then, Run in a northerly direction along Elsie St. to its intersection with the centerline of W. Ross St., then, Run in a westerly direction along W. Ross St. to its intersection with the Batesville city limits, then Run in a southernly then easternly direction along said city limits line to its intersection with the centerline of S. St. Louis St., then Run in a northerly direction along the centerline of S. St. Louis St. to its intersection with the centerline of Byers St., the point of beginning. WARD 3: Ward 3 shall be comprised of all that land within the City of Batesville described as follows: The area enclosed by a line beginning at the intersection of Poke Bayou and the east line of Section 8, Range 6 West, Township 13 North, then, Run in a southerly direction to the intersection of Poke Bayou with the centerline of N. Broad St., then Run in a northerly direction along N. Broad St. to its intersection with the centerline of W. Carter St., then, Run in a westerly direction along W. Carter St. to its intersection with the centerline of N. State St., then, Run in a northerly direction along N. State St. to its intersection with the centerline of W. Pine St., then, Run in a westerly direction along W. Pine St. to its intersection with the centerline of Elsie St., then, Run in a northerly direction along Elsie St. to its intersection with the centerline of W. Ross St., then, Run in a westerly direction along W. Ross St. to its intersection with the Batesville city limits, then Run in a northerly direction, then easterly, then southerly direction along said city limits to the intersection of the east line of Section 8, Range 6 West, Township 13 North, the point of beginning. College Ave. to its centerline intersection with the centerline of Gwyn St., then, Run north along Gwyn St. to its centerline intersection with the centerline of Bearette St., then, Run east along Bearette St. centerline to the mid -point of a curve running to the south, then, Run due north along a line to its intersection with the Batesville city limits, then Run in a generally easterly, then northerly direction along said city limits line to its intersection with the centerline of E. Main St., then, Run in a northerly direction along E. Main St. to its intersection with the Batesville city limits, then, Run in an easterly, then southerly, then easterly direction along said city limits to its intersection with the centerline of Harrison St., then, Run in a westerly direction along the centerline of Harrison St. to its intersection with the centerline of Tanglewood St., then, Run along Tanglewood St. to its intersection with the centerline of 26th St., then, Run in a northerly direction along the centerline of 26th St. to its intersection with the centerline of Byers St., then, Run in a westerly direction along Byers St. to its intersection with the centerline of 20th St., then, Run in a northerly direction along the centerline of 20th St. to its intersection with the centerline of Porter St., then, Run in a westerly direction along the centerline of Porter St. to its intersection with the centerline of 19th St., the point of beginning. Section 2: A colored map, labeled EXHIBIT "A", showing the boundary lines for each Ward as outline above, hereby attached and made a part hereof and shall take precedent if the extremely irregular city limit boundaries results in the questioning of the intent or accuracy of the descriptions in Section 1, above. Section 3: The wards described herein shall comprise the new wards for the City of Batesville and will comprise the wards for the next alderman election held, and in each subsequent election until further modified by the City Council. Section 4: The Council person who are currently serving in the old Wards shall continue to serve until the new Council is formed at the first regular meeting of the City Council in January 2023 as per the results of the November 2022 General Election. EMERGENCY CLAUSE: Whereas it is necessary to effect the public peace, health, safety and welfare and the orderly administration of the primary and general elections in 2021 of the City an emergency is hereby declared to exist and this Ordinance shall be effective from and after the date of its passage.
