CITY OF BATESVILLE, ARKANSAS
A RESOLUTION ACCEPTING THE AMENDMENT TO THE FACILIr rPLAN PREPARED
BY MCGOODWIN,WILLIAMS AND YATES WHICH WAS PREVIO SLY APPROVED
BY THE ARKANSAS NATURAL RESOURCES COMMISSION IN CC MPLIANCE WITH
THE CLEAN WATER STATE REVOLVING LOAN FUND PROGRAM.
WHEREAS, the City of Batesville, Arkansas, is in the process of making certain
improvements to its Wastewater system; and
WHEREAS, the City of Batesville had a Facility Plan prepared in accordance with the
State Revolving Fund Regulations and 40 CFR Part 35, recommending certain improvements to
the City's Wastewater system;
WHEREAS, the Facility Plan was adopted by the City of Batesville pon passage of
Resolution No. 2010-1-1-R on January 12, 2010; and
WHEREAS, as the project progressed, the parties anticipated revisions regarding the
�,• amount of line replacement, and it has become necessary to make those revisions and amend the
Facility Plan.
NOW,THEREFORE, BE 1T RESOLVED by the City Council of tl te City of Batesville,
Arkansas:
Section 1. That the City of Batesville,Arkansas,hereby concurs with the recommended
amendment to the Facility Plan; and
Section 2. That the proposed recommended facilities are to continue to be funded with the
Clean Water State Revolving Fund, administered by the Arkansas Natural Resources
Commission on behalf of the U. S. Environmental Protection Agency; and
Section 3. That, with the approval of the Arkansas Natural Reso cc s Commission, the

City of Batesville,Arkansas, intends to complete construction, then operate and maintain such
facilities in accordance with State and Federal requirements.
