KNOW ALL MEN BY THESE PRESENTS: THAT I/We, Elvin Lee Girtman and Betty Girtman, husband and wife, hereinafter called "Grantor" whether one or more, for and in consideration of the sum of ONE DOLLAR($1.00), and other valuable consideration, cash in hand paid by the CITY OF BATESVILLE, ARKANSAS, Independence County, the receipt of which is hereby acknowledged, do hereby grant, sell and convey to the CITY OF BATESVILLE hereinafter called "GRANTEE", its successors and assigns, the right of way and the right from time to time to lay, to construct, to reconstruct, replace, renew, maintain, operate, change the size of and remove pipelines and/or mains for the purpose of carrying wastewater, the right to install valves, manholes, or other equipment necessary for the proper operation or protection of said mains, over,through or under and across hereinafter described. PROPERTY DESCRIPTION: DEED Book R-15 Page 683 North Half of Lot Four (4), Block One (1), Leonard's Addition to the City of Batesville, Arkansas. TRACT A—SL 3-2 EASEMENT DESCRIPTION: A permanent easement being 20.00 feet in width, being 10.00 feet on each side of the centerline of this permanent easement running East/West across Grantor's above described property. The centerline of this permanent easement shall be the centerline of the sewer line as constructed, said centerline also described as follows: Commence at the found rebar pin marking Grantor's Northeast property corner and run thence South 00° 23' 18" West along Grantor's East property line a distance of 31.90 feet to said centerline of said sewer line as constructed for the "TRUE POINT OF BEGINNING" of this permanent easement description; thence leaving said East property line North 86° 30' 52" West along said centerline a distance of 72.21 feet to Grantor's West property line for the end of this permanent easement, containing 1,444 square feet or 0.03 acres, more or less. TEMPORARY CONSTRUCTION EASEMENT DESCRIPTION: Also, a temporary construction easement being all the area between the North line of the above described permanent easement and the South right of way line of Highway 106, containing 1,160 square feet or 0.03 acres, more or less. This temporary construction easement shall terminate when the waterline construction is complete and has been accepted by the City of Batesville, Arkansas. TRACT B—SL 2-IA EASEMENT DESCRIPTION: A permanent easement 10.00 feet in width adjacent to and parallel with the East property line of Grantor's above described property. This permanent easement shall begin at the South right of way line of Highway 106 and extend South 00_23' 18 West along said East property line a distance of 21.90 feet and end at the North line of the TRACT A permanent easement described above, containing 219 square feet or 0.005 acres, more or less. TO HAVE AND TO HOLD the same unto the said GRANTEE, its successors and assigns forever,together with the right to ingress and egress for the purposes aforesaid, GRANTOR may perform any acts upon said lands not inconsistent with the rights herein granted except that no building or other permanent structure may be constructed by the GRANTOR upon the easement given herein. And the said GRANTOR covenants with the said GRANTEE, its successors and assigns that he will forever warrant and defend the title to said easement and rights against the claims of all persons whomsoever, and that GRANTEE, its successors and assigns shall have at all times a quiet use and enjoyment of said easement and rights.
