LIAISON REPORTS 11. COMMENTS FROM COUNCIL MEMBERS (by roll call) 12. ADJOURNMENT "City of Hospitality" ORDINANCE NO. AN ORDINANCE TO AMEND THE BATESVILLE ZONING DISTRICTS MAP; AND FOR OTHER PURPOSES. WHEREAS, the Batesville Planning Commission received a request to rezone certain properties at 1348 and 1350 Porter St; and WHEREAS, the Batesville Planning Commission conducted a properly advertised public hearing on July 11, 2022 to hear opinions about the proposed zoning revision; and, WHEREAS, the Batesville Planning Commission, at its called meeting on July 11, 2022, has determined that the proposed zoning revision is consistent with the Batesville Comprehensive Plan, as amended, and is in the best interest of the future development of the city; and, WHEREAS, the Batesville Planning Commission has recommended that the requested amendment to the Zoning Districts map be approved by the City Council. NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BATESVILLE, ARKANSAS: Section 1. The Batesville Zoning Districts Map is hereby amended from General Family Residential (R-2) to Commercial Community District (C-1) for the parcels identified as 110240900C and 1102411000 by the Independence County Assessors Office, the same being 1348 and 1350 Porter St, respectively. SECTION 2. If any portion or portions of this ordinance are deemed or held to be invalid, such invalidity shall not affect the remaining portion or portions of this ordinance. IT IS SO ORDAINED. A RESOLUTION TO WAIVE COMPETITIVE BIDDING FOR SLUDGE REMOVAL FROM THE BATESVILLE WASTEWATER TREATMENT PLANT. WHEREAS, the City of Batesville has bid out the removal of approximately of biosolids from the wastewater treatment lagoon of the Batesville Water Treatment plant as needed; WHEREAS, the City is in need of said removal; WHEREAS, that DRT BioSolids, Inc., of 7140 State Hwy 40, Bloomer, WI 54724, has been hired to remove said biosolids for over a decade, and has not had any other competitive bidders that would meet the Water Treatment Plant's specifications in over a decade; WHEREAS, DRT BioSolids, Inc. is currently working a project in Little Rock and can therefore offer the City the same rate as last year, 2021; WHEREAS, the Council is aware that inflation is currently high, and that the offer to remove said biosolids at last years rate presents the City with an opportunity to save money; WHEREAS, Arkansas Code Annotated § 14-58-303(b)(2)(B) allows this governing body by resolution to waive the requirements of competitive bidding in exceptional situations where bidding is deemed not feasible or practical; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF BATESVILLE, ARKANSAS: Section 1. That the Batesville Waste Water Treatment Plant immediately needs to remove approximately 2700 dry tons of biosolids. Section 2. That DRT BioSolids, Inc. has been the only qualified bidder to remove said biosolids for over a decade, and is offering to remove said bio solids at the same rate as last year's agreement with the City, which was $107.00 per dry ton. Section 3. That because DRT BioSolids, Inc. is uniquely qualified, the removal need is immediate, and DRT BioSolids, Inc. is offering the same rate as last year, competitive bidding is deemed to not be feasible or practical, Competitive bidding is hereby waived.
