A ORDINANCE TO WAIVE COMPETITIVE BIDDING FOR A GRAPPLE TRUCK WHEREAS, the City of Batesville is in need of a new grapple truck; WHEREAS, that there is currently a severe shortage of new grapple trucks due to a lack of certain computer chips as well as other materials; WHEREAS, that Hernard Utility Products, Inc. of Searcy has a slot available for purchase order in 2022; WHEREAS, if the City does not make said purchase order immediately, the City will not be unable to reasonably acquire a new grapple truck until 2023 through any vendor; and WHEREAS, Arkansas Code Annotated § 14-58-303(b)(2)(B) allows this governing body by resolution to waive the requirements of competitive bidding in exceptional situations where bidding is deemed not feasible or practical; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF BATESVILLE, ARKANSAS: Section 1. That the purchase of a New Pac-Mac KB20H0-HJ "Grapple Truck" from Henard Utility Products, Inc. for approximately $217,847.70 is hereby authorized. Section 2. That after diligent search it has been determined that this Grapple Truck uniquely meets the city's specifications and can be delivered in a timely fashion. Therefore, competitive bidding is deemed to not be feasible or practical, and is hereby waived. PASSED AND APPROVED this 9t" day of August, 2022. Honorable Rick Elumbaugh, Mayor ATTEST: Denise M. Johnston, City Clerk RESOLUTION NO. A RESOLUTION AUTHORIZING THE MAYOR AND CITY CLERK OF BATESVILLE, ARKANSAS TO ENTER INTO AN AGREEMENT WITH THE WHITE RIVER PLANNING AND DEVELOPMENT DISTRICT, INC. WHEREAS, Batesville, Arkansas has received notification of funding approval from the Arkansas Department of Emergency Management to provide funds for a drainage project; and WHEREAS, Batesville, Arkansas requires assistance to administer the funded drainage project; and NOW, THEREFORE, BE IT RESOLVED by the Batesville City Council: That the Mayor and City Clerk of Batesville, Arkansas be authorized to execute an Agreement with the White River Planning and Development District, Inc., to provide administrative services of said drainage project in accordance with the Grant application and award from the Arkansas Department of Emergency Management. Mayor ATTEST: City Clerk RESOLUTION # A RESOLUTION AUTHORIZING THE SALE OF THE CURRENT BATESVILLE POLICE DEPARTMENT TO BAD BOY MOWERS, LLC WHEREAS, the Batesville Police Department is currently located 51 Industrial Drive, Batesville, Arkansas; and WHEREAS, Bad Boy Mowers, LLC continues to expand and wishes to purchase said property in order to facilitate expansion of their production capacity; and WHEREAS, the City of Batesville is committed to the continued success and growth of our local and regional businesses; and WHEREAS, the City wishes to have a more centrally located Police Department. NOW, THEREFORE BE IT RESOLVED, BY THE CITY COUNCIL OF THE CITY OF BATESVILLE, ARKANSAS SECTION 1: That the City of Batesville hereby authorizes the sale of the Batesville Police Department located at 51 Industrial Drive, Batesville, Arkansas for the purchase price of $1,300,000, more or less to Bad Boy Mower, LLC, per the real estate purchase agreement which is attached hereto and incorporated herein by reference.
