A RESOLUTION AUTHORIZING THE MAYOR OF BATESVILLE, ARKANSAS, TO ENTER INTO AN ADMINISTRATIVE AGREEMENT WITH THE WHITE RIVER PLANNING AND DEVELOPMENT DISTRICT, INC. WHEREAS, Batesville, Arkansas, has received approval of funding from the Economic Development Administration (EDA) for a grant for the construction of a building; and WHEREAS, Batesville, Arkansas requires assistance to identify and implement the regulations pertaining to the said grant, and; WHEREAS, it will be necessary for the Mayor to act in connection with the Administrative Agreement; NOW, THEREFORE, IT IS RESOLVED that the City Council of Batesville, Arkansas hereby declares that the Mayor be authorized to execute an agreement with the White River Planning and Development District, Inc., to provide administrative services to the City. AN ORDINANCE GRANTING A FRANCHISE TO OPERATE AN AMBULANCE BUSINESS WITHIN THE CITY OF BATESVILLE WHEREAS, The Batesville Municipal Code requires any person wishing to engage in the ambulance business within the City of Batesville to first obtain a franchise from the City Council of the City of Batesville; WHEREAS, The City Council of the City of Batesville, in order to obtain an ambulance business which maintains emergency ambulance services continuously during all hours, may grant an exclusive franchise for the privilege of operating said ambulance business; and WHEREAS, The Batesville Municipal code designates that franchises for the purpose of operating an ambulance business shall be issued for periods not to exceed five (5) years. NOW THEREFORE, BE IT ORDAINED by the City Council of Batesville, Independence County, Arkansas, as follows: 1. The current exclusive franchise for the purpose of operating an ambulance business expires on September 13, 2022. 2. It is in the best interest for the inhabitants of the City of Batesville and all other persons within the city to have qualified emergency ambulance service available continuously during all hours. 3. Vital Link, Inc. applied for and was granted the franchise currently set to expire and has renewed its application for the franchise. 4. Vital Link, Inc. is hereby granted an exclusive franchise for operation of an ambulance business for a period of five (5) years. 5. Since this Ordinance is not of a general and permanent nature, it shall take effect immediately. PASSED AND APPROVED this day of , 2022. ATTEST: Denise M. Johnston, City Clerk Honorable Rick Elumbaugh, Mayor RESOLUTION # A RESOLUTION AUTHORI"LING THE PURCHASE OF THE PROPERTY LOCATED AT 710 ST. LOUIS ST. FROM FIRST COMMUNITY BANK WHEREAS, the Batesville Police Department is currently located 51 Industrial Drive, Batesville, Arkansas; and WHEREAS, that the City recently sold 51 Industrial Drive to Bad Boy Mowers, LLC in order to foster economic growth and to establish a more centrally located Police Department; and WHEREAS, the property located at 710 S. St. Louis Street meets the Police Department's needs as well as fulfilling the goal of having a more centrally located Police Department; and NOW, THEREFORE BE IT RESOLVED, BY THE CITY COUNCIL OF THE CITY OF BATESVILLE, ARKANSAS SECTION 1: That the City of Batesville hereby authorizes the purchase of 710 S. St. Louis Street, Batesville, Arkansas for the purchase price of $850,000, more or less to from First Community Bank, per the real estate purchase agreement which is attached hereto and incorporated herein by reference. ATTEST: Denise Johnston, City Clerk Rick Elumbaugh, Mayor RESOLUTION # A RESOLUTION AUTHORIZING THE PURCHASE OF THE PROPERTY LOCATED AT 1050 OAK STREET WHEREAS, that the City intends to purchase the building and property located at 710 S. St. Louis St. to house a new police department; and WHEREAS, that the property located at 1050 Oak Street is contiguous with the property located at 710 S. St. Louis St. and will be needed for additional parking at the new police department. NOW, THEREFORE BE IT RESOLVED, BY THE CITY COUNCIL OF THE CITY OF BATESVILLE, ARKANSAS SECTION 1: That the City of Batesville hereby authorizes the purchase of 1050 Oak Street, Batesville, Arkansas for the purchase price of $125,000, more or less per the real estate purchase agreement which is attached hereto and incorporated herein by reference. Rick Elumbaugh, Mayor ATTEST: Denise Johnston, City Clerk RESOLUTION # A RESOLUTION AUTHORIZING THE PURCHASE OF THE PROPERTY LOTS 1 AND 2 OF SCHOOL ADDITION TO THE CITY OF BATESVILLE WHEREAS, that the City intends to purchase the building and property located at 710 S. St. Louis St. to house a new police department; and WHEREAS, that the property located at the Lot 1 and Lot 2 of the School Addition is located near 710 S. St. Louis St. and will be needed for additional parking at the new police department. NOW, THEREFORE BE IT RESOLVED, BY THE CITY COUNCIL OF THE CITY OF BATESVILLE, ARKANSAS SECTION 1: That the City of Batesville hereby authorizes the purchase of Lots 1 and 2, of the School Addition, Batesville, Arkansas for the purchase price of $150,000, more or less per the real estate purchase agreement which is attached hereto and incorporated herein by reference. Rick Elumbaugh, Mayor ATTEST: Denise Johnston, City Clerk RESOLUTION # A RESOLUTION AUTHORIZING THE PURCHASE OF THE FOOD TRUCK LOT LOCATED AT 201 S. CENTRAL AVENUE. WHEREAS, the City of Batesville desires to expand economic, entertainment, and culinary opportunities within the City; and WHEREAS, the Food Truck Lot located on Central Avenue is available for purchase; and WHEREAS, the City wishes to further develop said property with a pavilion, green space, splash pad, and food truck lot. NOW, THEREFORE BE IT RESOLVED, BY THE CITY COUNCIL OF THE CITY OF BATESVILLE, ARKANSAS SECTION 1: That the City of Batesville hereby authorizes the purchase of 201 S. Central, Batesville, Arkansas for the purchase price of $150,000, more or less to from Vida Enterprises, per the real estate purchase agreement which is attached hereto and incorporated herein by reference. Rick Elumbaugh, Mayor ATTEST: Denise Johnston, City Clerk RESOLUTION NO: A RESOLUTION FOR THE CITY OF BATESVILLE, ARKANSAS TO ACCEPT THE LOW BID AND ENTER INTO A CONTRACT WITH C& S CONTRACTING, LLC FOR THE CONSTRUCTION OF A PUBLIC WORKS FACILITY; AND FOR OTHER PURPOSES. WHEREAS, the City of Batesville is in need of a Public Works Facility ("Project") to house all of its maintenance, construction, street, sanitation, water, and landscape departments and equipment; WHEREAS, the Project was properly advertised for competitive bids per Arkansas Code Annotated § 14-58-303; WHEREAS, the City of Batesville desires to accept the low bid and enter into a contract for the Project; WHEREAS, the low bidder meeting qualifications and the firm selected for the Project is C & S Contracting, LLC, who was the only bidder on the project; WHEREAS, the total amount of the Project Bid Proposal is $5,910,000, more or less, and will be paid from monies collected from the City of Batesville Operating Budget. NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL FOR THE CITY OF BATESVILLE, ARKANSAS THAT: Section 1. That the City of Batesville shall accept the low bid and enter into a contract for the Construction of the Batesville Public Works Facility C & S Contracting, LLC. Section 2. The total amount for the contract is for $5,910,000, more or less, and will be paid from the City of Batesville Operating Budget. Section 3. The Mayor and City Clerk are hereby authorized by the City Council for the City of Batesville to execute all documents necessary to effectuate this agreement. Rick Elumbaugh, Mayor ATTEST: Denise Johnston, City Clerk ORDINANCE # AN ORDINANCE ADOPTING THE CITY OF BATESVILLE EMPLOYEE HANDBOOK FOR THE CITY OF BATESVILLE; AND FOR OTHER PURPOSES WHEREAS, from time to time it is necessary to update and modify the City's Employee Handbook; and WHEREAS, it has been several years since the City's Employee Handbook has been updated; and WHEREAS, since the last amendment to the City's Employee Handbook, the City has added a information technology department which has policies to be included in the Handbook; and WHEREAS, the City Council finds and determines that the adoption of the said policy is in the best interest of the employees of the city of Batesville and its citizens. NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL FOR THE CITY OF BATESVILLE, ARKANSAS: Section 1. The updated City of Batesville Employee Handbook presented to the city council is hereby adopted. Section 2. All previous versions of the City of Batesville Employee Handbook are hereby nullified. EMERGENCY CLAUSE: The City of Batesville Employee Handbook affects the employees of the city departments, who in turn contribute to the safety and welfare of the residents of Batesville, Arkansas; therefore an emergency is hereby declared to exist and this Ordinance shall be in full force and effect from and after its passage.
