A RESOLUTION TO ADDRESS PREMIUM PAY FOR CERTAIN CITY OFFICIALS FROM THE AMERICAN RESCUE PLAN GRANT TO THE CITY BUDGET FOR 2021. WHEREAS, the American Rescue Plan Act "ARPA," provides fiscal relief funds to state and local governments and other program areas aimed at mitigating the continuing effects of the pandemic and it provides for four eligible use funding categories including the ability to provide Premium Pay and other pay for certain eligible city workers; and WHEREAS, the Batesville City Council adopted Resolution # on to provide for Premium Pay or bonuses and this included some elected officials including the Mayor, the City Clerk and the City Attorney; and WHEREAS, on Thursday, January 6, 2022, the United States Treasury published the ARPA Final Rule with Commentary stated that the Uniform Grant Guidelines (UGG) and the Award Terms and Conditions do not permit elected officials to receive any Rescue grant funds because of UGG's conflict of interest provisions; and WHEREAS, this funding has already been paid. NOW, THEREFORE, be it resolved by the Batesville City Council, that: The City Council directs the Batesville City Clerk to move the expenditures for the Premium Pay and the applicable employer payroll contributions for the City elected officials in the total amount of $ from the Rescue / ARPA grant fund to the City General Revenue Fund and the city hereby amends its grant expenses to reflect a decrease in expenses and moves them to the City General Revenue budget which will increase the expenses. Johnston, City Clerk CERTIFICATE OF LEVY OF TAXES BY BATESVILLE, ARKANSAS A MUNICIPAL CORPORATION The City Council of the City of Batesville, Arkansas, in regular session, assembled on the 1811 day of October, 2022, voted to re -levy rates of taxation on real property and personal property in said City for the year 2022 and payable in 2023, the following: CITY GENERAL --------------------------------------- 5 Mills FIREMEN'S PENSION ------------------------------ 1 Mills and authorized and directed that such action be certified to the Quorum Court of Independence County, Arkansas, and to the County Clerk of said County, to the end that the same be duly levied and extended on the tax books; and it is hereby so certified on the 18th day of October, 2022.
