AN ORDINANCE TO AMEND VARIOUS PROVISIONS OF THE BATESVILLE ZONING
CODE; TO ADD DEFINITIONS; TO CLARIFY PERMITTED USES; AND FOR OTHER
PURPOSES.
WHEREAS,the Batesville Planning Commission determined that the Batesville Zoning Code
needs to clarify regulations pertaining to low impact cultural and recreational uses in residential zoning
districts; and,
WHEREAS,the Batesville Planning Commission has prepared recommendations to improve the
clarity of the Batesville Zoning Code and conducted a public hearing on March 7,2022, and voted at a
regular meeting on March 7, 2022 to recommend said revisions to the Batesville City Council; and,
WHEREAS,the Batesville City Council concurs in the recommendations of the Planning
Commission
NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
BATESVILLE,ARKANSAS THAT THE BATESVILLE ZONING CODE,THE SAME BEING
TITLE 14 OF THE BATESVILLE MUNICIPAL CODE,IS HEREBY AMENDED AS
FOLLOWS:
Section 1. Amend the definitions in Section 14.02.02, subsection B., by Inserting the following between
"Lodging Room"and "Manager/Caretaker Residence":
"Low Impact Cultural and Recreational Facility. Any facility, such as a senior citizen
center,designed to provide socialization, recreation, or related activities. Such facility
should normally be limited to not more than 200 person at any one time and not provide
any temporary or permanent residential occupancy, except during disaster related
emergencies."
Section 2. Amend Section 14.06.01 by adding the following:
"5. Low impact cultural and recreational facilities"
Section 3. Amend Section 14.06.03. by adding the following:
"11. Low impact cultural and recreational facilities
Section 4. Amend Section 14.07.02 by adding the following:
"19. Low impact cultural and recreational facilities"
Section 5. If any portion or portions of this ordinance are deemed or held to be invalid, such invalidity
shall not affect the remaining portion or portions of this ordinance.
Section 6. It is hereby determined that an opportunity to receive grant assistance to develop a needed
development of a much needed modern facility for the benefit of the senior citizens of
Batesville and an emergency is hereby declared and this ordinance shall be in full force and
effect from and after the date of its passage and approval.
IT IS SO ORDAINED.
