RESOLUTION NO. 10-0o2— 11 <br /> A RESOLUTION TO WAIVE COMPETITIVE BIDDING FOR A BANDIT BEAST <br /> RECYCLER <br /> WHEREAS, the City continues to grow, and said growth produces more waste wood; <br /> WHEREAS, the City of Batesville is therefore in need of a new Horizontal Grinder for <br /> waste wood; <br /> WHEREAS, that the City is short staffed and the economic trends point to a smaller <br /> pool of workers over the next five years; <br /> WHEREAS, that the City is moving to be more efficient with wood byproduct <br /> recycling; <br /> WHEREAS, that a new grinder would make employee labor less physically demanding <br /> and safer; <br /> WHEREAS, that the need is immediate and the wait time for said Grinder is two years <br /> and no other provided has responded to requests for estimates; and <br /> WHEREAS, Arkansas Code Annotated § 14-58-303(b)(2)(B) allows this governing <br /> body by resolution to waive the requirements of competitive bidding in exceptional situations <br /> where bidding is deemed not feasible or practical; <br /> NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF BATESVILLE, <br /> ARKANSAS: <br /> Section 1. That the purchase of a 2023 Bandit Beast Recycler 2460XP from Crouse <br /> Truck Parts and Equipment, Inc. for approximately $495,642.00 more or less is hereby <br /> authorized. <br /> Section 2. That after diligent search it has been determined that the 2023 Bandit <br /> Recycler from Crouse Truck Parts and Equipment, Inc. is the only provider that has <br /> responded to the city's specifications and that the need is immediate with the wait list for the <br /> equipment being two years. Therefore, competitive bidding is deemed to not be feasible or <br /> practical, and is hereby waived. <br /> PASSED AND APPROVED this of October, 2022. <br /> Honorable Rick Elu , Mayor <br /> Denise M.
