A RESOLUTION TO WAIVE COMPETITIVE BIDDING FOR A BANDIT BEAST
RECYCLER
WHEREAS, the City continues to grow, and said growth produces more waste wood;
WHEREAS, the City of Batesville is therefore in need of a new Horizontal Grinder for
waste wood;
WHEREAS, that the City is short staffed and the economic trends point to a smaller
pool of workers over the next five years;
WHEREAS, that the City is moving to be more efficient with wood byproduct
recycling;
WHEREAS, that a new grinder would make employee labor less physically demanding
and safer;
WHEREAS, that the need is immediate and the wait time for said Grinder is two years
and no other provided has responded to requests for estimates; and
WHEREAS, Arkansas Code Annotated § 14-58-303(b)(2)(B) allows this governing
body by resolution to waive the requirements of competitive bidding in exceptional situations
where bidding is deemed not feasible or practical;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF BATESVILLE,
ARKANSAS:
Section 1. That the purchase of a 2023 Bandit Beast Recycler 2460XP from Crouse
Truck Parts and Equipment, Inc. for approximately $495,642.00 more or less is hereby
authorized.
Section 2. That after diligent search it has been determined that the 2023 Bandit
Recycler from Crouse Truck Parts and Equipment, Inc. is the only provider that has
responded to the city's specifications and that the need is immediate with the wait list for the
equipment being two years. Therefore, competitive bidding is deemed to not be feasible or
practical, and is hereby waived.
PASSED AND APPROVED this of October, 2022.
