A RESOLUTION TO WAIVE COMPETITIVE BIDDING FOR A GRAPPLE TRUCK
WHEREAS,the City of Batesville is in need of a new grapple truck;
WHEREAS,that there is currently a severe shortage of new grapple trucks
due to a lack of certain computer chips as well as other materials;
WHEREAS,that Hernard Utility Products, Inc. of Searcy has a slot available
for purchase order in 2022;
WHEREAS, if the City does not make said purchase order immediately,the
City will not be unable to reasonably acquire a new grapple truck until 2023
through any vendor; and
WHEREAS,Arkansas Code Annotated § 14-58-303(b)(2)(B) allows this
governing body by resolution to waive the requirements of competitive bidding in
exceptional situations where bidding is deemed nbt feasible or practical;
NOW,THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF BATESVILLE,
ARKANSAS:
Section 1. That the purchase of a New Pac-Mac KB20H0-HJ "Grapple Truck"
from Henard Utility Products, Inc. for approximately$217,847.70 is hereby
authorized.
Section 2. That after diligent search it has been determined that this Grapple
Truck uniquely meets the city's specifications and can be delivered in a timely
fashion. Therefore, competitive bidding is deemed to not be feasible or practical,
and is hereby waived.
PASSED AND APPROVED this 9th day of August, 2022.
