ORDINANCE NO.
AN ORDINANCE TO AMEND THE PROPERTIES INCLUDED IN THE
BATESVILLE COMMERCIAL HISTORIC DISTRICT; AND FOR OTHER
PURPOSES.
WHEREAS, it is the duty of the Batesville Downtown Historic District
Commission to safeguard the city's historic, aesthetic, and cultural heritage, as embodied
and reflected in such areas; and
WHEREAS, the Historic District Commission has the power to recommend to
the City Council the adoption of ordinances designating areas as having special historic
community or architectural value as "Historic District" and add these historic districts to
the provisions of this ordinances; and,
WHEREAS, the original boundary of the Batesville Downtown Historic District
conformed to the boundary of the National Register for said district, as per state law; and
WHEREAS, the boundary of said National Register has recently expanded,
therefore the Historic District Commission is recommending to the city that the Historic
District be expanded in order to conform with said Register; and,
WHEREAS, the City wishes the Historic District Commission's boundary to
remain in conformity with the National Register bounday.
NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF BATESVILLE, ARKANSAS AS FOLLOWS:
Section 1: That Ordinance No. 2009-4-2, Sec 2., Titled "Batesville downtown
commercial Historic District", and Codified as 7.60.02 is hereby amended
as follows:
The Historic District shall consist of that area of the city shown on Exhibit 1,
which is attached hereto and made a part hereof. The downtown commercial Historic
District in Batesville, Arkansas is described as follows:
All properties facing Main and Central in Block 13; all properties facing
Main in Block 14; all of Block 15; all properties on Main in Blocks 16, 17, 18, 19,
and 20; and all properties fronting on Main on the north side of Block 21. On Block
35 bordered by College, Broad, Boswell, and Central, the half fronting on Broad,
more specifically the following parcels in the Old Town addition: Block 13, Lots 5-
10; Block 14, Lots 1-5; Block 15, Lots 1-10; Block 16, Lots 6-10; Block 17, Lots 5-8;
Block 18, Lots 1-4; Block 19, Lots 1-5; Block 20, Lots 6-10; Block 21, Lots 5-8; and
the one half of Block 35 facing Broad.
Section 2: That the City of Batesville Zoning Map shall be amended to reflect the
description of the Historic District contained in this ordinance.
Section 3: That all ordinances and parts thereof in conflict herewith are hereby
repealed to the extent of such conflict.
Section 4: If any portion or portions of this ordinance are deemed or held to be
invalid, such invalidity shall not affect the remaining portions of this
ordinance.

ORDINANCE NO.
AN ORDINANCE AMENDING THE TEMPORARY ENTERTAINMENT DISTRICT
BOUNDARIES IN RIVERSIDE PARK IN BATESVILLE, ARKANSAS
WHEREAS, that through the diligent efforts of Main Street Batesville, as well as the support of
the City of Batesville and the residents of Independence County, Batesville was one of thirty-three towns
and cities Nationally awarded a Levitt Foundation Grant to be used to fund a summer concert series, and
WHEREAS, said concert series will be held at the Amphetheatre at Riverside Park; and
WHEREAS, last year the City established a Temporary Entertainment District ecompassing
the area at Riverside Park from south from Steelhouse Branch between the White River and Chaney
Drive to the River restaurant.
WHEREAS, that in order to better promote the atmosphere surrounding these concerts, the
Tempoaray Entertainment District should be expanded to encompass the areas around the
Ampetheater, and
WHEREAS, the Council believes that the expansion of a temporary entertainment district will
help promote business and tourism., and
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
BATESVILLE, ARKANSAS, AS FOLLOWS:
Section 1. That "Exhibit A"of Section 1 Ordinance Number 2022-06-02, which
established the Temporary Entertainment District at Riverside Park is hereby amended as outlined
in "Exhibit A" which is attached hereto and incorporated herein by reference.
Section 2. That all ordinances and parts thereof in conflict herewith are hereby repealed to
the extent of such conflict.
Section 3. If any portion or portions of this ordinance are deemed or held to be invalid, such
invalidity shall not affect the remaining portions of this ordinance.
Section 4. It is, therefore, declared that an emergency exists and this Ordinance being
necessary for the immediate preservation of public peace, health, safety and welfare shall be in force
and take effect immediately upon its passage.

Description of Temporary Entertainment District in Riverside Park
Southeasetern Section of the Temporary Entertainment District:
A part of Section 21, Township 13 North, Range 6 West in Independence County, Arkansas described as
follows:
Beginning at the intersection of the north bank of Stillhouse Branch with the left bank (north bank) of White
River; thence in an easterly direction along and with the north bank of Stillhouse Branch to the centerline of
Cheney Drive; thence in a generally southeasterly direction along and with the centerline of Cheney Drive to a
point at its intersection with the centerline (extended) of Riverbank Road; thence in a generally southerly to a
point perpendicular to the northwest corner of Tract 1 of the James Burnett and Sabina Burnett Revocable Trust,
recorded as Warranty Deed in Deed Book 2019, pages 2549-2551; thence to said northwest corner of said
property; thence along the west boundary of said property as follows: South 63 degrees 30 minutes West a
distance of 79.6 feet; thence South 34 degrees 43 minutes East a distance of 99.0 feet; thence South 54 degrees
43 minutes West a distance of 200.6 feet; thence leaving said Burnett property line following continuing along a
line bearing South 54 degrees 43 minutes to its intersection with the left bank (north bank) of the White River,
the same being the corporate limits of the City of Batesville, more or less; thence in a generally northwestern
direction along and with the left (northern) bank of White River to its intersection with the north bank of
Stillhouse Branch and the beginning point of this description.

RESOLUTION NO.2023-
A RESOLUTION TO CONTRACT WITH ECOLOGICAL DESIGN GROUP AND
TAGGERT ARCHITECTS FOR THE DEVELOPMENT OF A MASTER PLAN FOR
RIVERSIDE PARK
WHEREAS, the City of Batesville desires to enter into a contract for the development of a
Master Plan for Riverside Park;
WHEREAS, EDG and Taggert Architects were selected through a Statement of Qualifications
process and were found to be the most qualified firms to provide these design services;
WHEREAS, the total amount of the contract is $65,000.00, more or less, and will be paid from
monies from the City of Batesville ARPA Fund.
NOW, THEREFORE BE IT RESOLVED. by the City Council of the City of Batesville,
Arkansas that
SECTION 1: That the City of Batesville, Arkansas will enter into a contract for the Development
of a Master Plan for Riverside Park with EDG and Taggert Architects.
SECTION 2: The total amount for the contract is for $65,000.00, more or less, and will be paid
from the City of Batesville ARPA Fund.
SECTION 3: The Mayor, Rick Elumbaugh and City Clerk, Denise Johnston are hereby
authorized by the City Council for the City of Batesville to execute all documents necessary to
effectuate the agreement.

Re: Riverside Park & Event Center — Master Plan Development
Dear Jeff,
Per your request, we are pleased to submit the following proposal for professional design and planning services for
the Riverside Park and Event Center Master Plan. The intent of this visionary design phase is to strategically plan the
event center and park space so that they are cohesive designs and create the hub for outdoor recreation for the
community and enhance the public space in the form of a new active lifestyle park.
SCOPE OF SERVICES
The purpose of the services proposed herein is to provide professional design services for the development of
Riverside Park; including a new event center and the re -envisioning of the Riverside Park space. This scope of work
includes evaluation of all existing infrastructure and planned development of the surrounding property including the
water treatment facility. Important considerations regarding access, circulation, parking and new event center will
need to be carefully planned so an emphasis is placed on the experience of arrival and new amenities for the
community. Watershed conservation will play a major role in its relationship to the White River while connection to
the surrounding bike/pedestrian connectivity network needs to be strategic and immersive while also providing
passive and active recreation opportunities all user groups. Finally, community and stakeholder involvement
throughout the master planning process will be important to build buy -in; and attract potential financial
contributions for the development. The master plan shall be developed utilizing the GIS and electronic base
information provided by the City of Batesville.
Task A: Due Diligence and Site Inventory + Analysis:
Typical and basic inventory and analysis of site, demographic, cultural, historical, and other elements and plans
necessary to understand the context of the site and its surroundings. Graphics detailing this information will be
included in the planning process and final master plan documents. This site is impacted directly by the White River
and has connectivity ties to Poke Bayou, and other natural upland drainage corridors that have the potential to
create programming and connectivity opportunities. These areas are important as well as an understanding of
aquatic and terrestrial ecosystems present on site. Connections to surrounding land uses, particularly the
commercial downtown food truck lot, municipal, housing and trail systems are important. Pedestrian and bike
connectivity to the park and within the park are critical. Review of other city plans for relevant information is
necessary to properly plan.

5. Ecological + Site Micro -climate Analysis

Task B: Final Master Plan Document:
EDG +Taggart will develop the final graphic master plan with a cost estimate for all park features, event center
building and final program elements. The final master plan will include an illustrative, to scale high quality drawing
showing plan elements encompassing the full park acreage with the layout of all program and ecological elements,
all park vehicular, bike, and pedestrian circulation including connections to surrounding land uses, downtown food
truck lot, utility corridors, ecological areas, and historical elements. The plan will also identify a theme that helps
guide the overall design of the park and will create the destination public park space for the City of Batesville and
surrounding region.

Task C: Construction Documents (option to proceed)
After construction funding has been received, EDG +Taggart will develop the final full -service design and
construction documents for all park features, event center building and final program elements. The deliverables
and fees will be based upon the Arkansas Division of Building Authority's Standard Fee Schedule for Professional
Services.

REMUNERATION
We propose to perform Basic Services work described above based on a lump sum fee as indicated below.

TASK B: Final Master Plan Document:
Parks and Land Use Planning $40,500
Building and Venues Planning $15,000
Total Master Plan Services 565.000
Inclusive of all Reimbursable Expenses

RESOLUTION NO.2023-
A RESOLUTION APPROVING THE DESTRUCTION OF
CERTAIN OUTDATED DOCUMENTS OF THE CLERK -TREASURER'S
OFFICE AND THE BATESVILLE WATER UTILITY OFFICE
WHEREAS, the Clerk -Treasurers Office of the City of Batesville and the
Batesville Water Utility Office, have accumulated a large amount of outdated records and
materials; and
WHEREAS, due to the lack of storage space, it has become necessary to destroy
certain outdated documents to allow current data adequate space to be stored; and
WHEREAS, Ark. Code Annotated Section 14-59-114 allows for the destruction
of said records if supported by an affidavit signed by the municipal employee performing
the destruction and one council member.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Batesville, Arkansas that
Section 1: Pursuant to the above -cited Code provision, the supporting affidavits
signed by Denise Johnston, City Clerk, Nike Baxter, Water Utility Office Manager and
Thomas Bryant, Alderman, the City Council does hereby give its approval for the
destruction of the documents as set forth in the affidavits and attachments, which are
attached hereto and made a part hereof as though set out word for word.
Section 2: This resolution shall be in full force and effect from and after the date
of its passage.
