PROCLAMATION AND BALLOT
STATE OF ARKANSAS
COUNTY OF INDEPENDENCE
I, the undersigned, City Clerk of the City of Batesville, Arkansas (the "City"),
hereby certify that the Certificate of the Independence County Board of Election Commissioners
certifying the vote at the election held in the City on August 8, 2023 on the questions of (a)
approving or rejecting Ordinance No. 2023-05-02, which if approved, would amend Ordinance
No. 2011-12-05 in order to authorize the net collections of the 0.5% sales and use tax levied
within the City by Ordinance No. 2011-12-05 (the "Tax") to be used to pay and secure the
repayment of bonds approved by the voters and issued by the City from time to time to finance
and refinance all or a portion of the costs of capital improvements, has been filed in my office
and presented to the Mayor and reflects that 2" votes were cast FOR the measure and
votes were cast AGAINST it; (b) issuing bonds in the maximum aggregate principal amount o
$12,820,000 for the purpose of refunding the City's Sales and Use Tax Bonds, Series 2012 and,
in order to pay the bonds, the pledge of the Tax, has been filed in my office and presented to the
Mayor and reflects that isR votes were cast FOR the measure and votes were cast
AGAINST it; (c) issuing bonds in the maximum aggregate principal amount of $25,985,000 for
the purpose of financing all or a portion of the costs of park and recreational facilities and
improvements and any necessary land acquisition, demolition, furnishings, equipment and
parking, lighting, landscaping, street, drainage and utility improvements related thereto and, in
order to pay the bonds, the pledge of the Tax, has been filed in my office and presented to the
Mayor and reflects that Sqo votes were cast FOR the measure and.L-LQ votes were cast
AGAINST it; and (d) issuing bonds in the maximum aggregate principal amount of
$110,000,000 for the purpose of financing all or a portion of the costs of acquiring, constructing
and equipping extensions, betterments and improvements to the City's water system and any
necessary demolition related thereto and, in order to pay the bonds, the levy and pledge of a 1 %
local sales and use tax within the City, has been filed in my office and presented to the Mayor
and reflects that 9& votes were cast FOR the measure and A3% votes were cast AGAINST it.
I certify that the copy of the printed ballot attached to the Certificate of the
Independence County Board of Election Commissioners is a true and correct copy of the ballot
used at the Special Election, a copy of which has been filed in my office.
I further certify that the attached Proclamation is a true and compared copy of a
Proclamation of the Mayor of the City, canvassing the returns of the election and declaring the
results thereof, which is now of record in the office of the City Clerk.
