COMMENTS FROM THE MAYOR 10. LIAISON REPORTS 11. COMMENTS FROM COUNCIL MEMBERS (by roll call) 12. ADJOURNMENT "City of Hospitality" ORDINANCE NO. AN ORDINANCE TO AMEND THE BATESVILLE ZONING DISTRICTS CODE; AND FOR OTHER PURPOSES. WHEREAS, the Batesville Planning Commission has been in continuing deliberations regarding the advisability of permitting certain non-residential uses within residential zoning districts, and more specifically within the R-1 Single Family Residential District; and, WHEREAS, the Batesville Planning Commission determined that a moderate expansion of permitted public or quasi -public uses on a conditional basis, if done in accordance with the Comprehensive Plan, would be appropriate and in the best interests of the city; and, WHEREAS, the Batesville Planning Commission conducted a properly advertised public hearing on October 2, 2023 to hear public comment about the proposed Zoning Code revision; and, WHEREAS, the Batesville Planning Commission, at its regular meeting on October 2, 2023, has determined that the proposed zoning revision is consistent with the Batesville Comprehensive Plan, as amended, and is in the best interest of the future development of the city; and, WHEREAS, the Batesville Planning Commission has recommended that the requested amendment to the Zoning Code be approved by the City Council. NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BATESVILLE, ARKANSAS: Section 1. Subsection B. "Conditional Uses" of Section 14.06.01. "Single -Family Residential District [R-1 ]" of the Batesville Zoning Code is hereby amended to add the following: 6. Public facilities such as quiet government offices not involving any form of incarceration; 7. Quasi -public facilities such as non-residential educational and/or vocational training facilities during daytime hours, or similar uses SECTION 2. If any portion or portions of this ordinance are deemed or held to be invalid, such invalidity shall not affect the remaining portion or portions of this ordinance. SECTION 3. The Council is aware that a transfer of property ownership between the Batesville School District and the Independence County Sheriffs Office is imminent and needs to be concluded before the end of the year and that such transfer is in the best interest of the future development of the city; therefore, an emergency is hereby declared to exist and this ordinance shall be in effect from and after its passage.
