CITY OF BATESVILLE ET AL LAWSUIT AND APPROPRIATING THE FUNDS FOR DOING SO Whereas, the City of Batesville is a named defendant in the matter of Ernest Timothy Bishop v. City of Batesville; Anthony Carter, Individually and in his Official Capacity; and Andrew Rogers, Individually and in his Official Capacity, in the United States District Court, Eastern District, Batesville Division, Case Number 1:13-CV-097-JLH; Whereas, upon advice of legal counsel and to avoid the further anticipated costs of litigation, the City has determined that settling the aforementioned matter is the best course of economic action; NOW, THEREFORE, BE IT RESOLVED the City Council of the City of Batesville, Arkansas does hereby resolve as follows: Section 1. That the City Council of the City of Batesville, Arkansas, does hereby determine to settle the claims being brought against it by Ernest Timothy Bishop by paying $7500.00 to Mr. Bishop and his attorneys in exchange for the dismissal of all claims against the City of Batesville. Section 2. That the City Council of the City of Batesville, Arkansas, does hereby appropriate $7500.00 from the general fund to pay to Mr. Bishop and his attorneys to settle the aforementioned litigation. PASSED, APPROVED, AND ADOPTED at a regular meeting of the City Council of the City of Batesville, Arkansas, held on the 10`" day of February, 2015. Rick Elumaugh, Mayor ATTEST: )-n. cw - Denise M. Johnston, Cit Clerk Section 2. The City Council of the City of Batesville hereby directs that the Batesville Police Department may have up to sixty (60) appointed subordinate police officers. Section 3. This ordinance repeals any ordinances or parts of ordinances in conflict herewith. Section 4. EMERGENCY CLAUSE: Because the orderly administration of law enforcement in the City of Batesville is vital for the protection of life, liberty, and property, and it being necessary to protect and preserve the health, safety, and welfare of the people of the City of Batesville, an emergency is declared to exist and this Ordinance shall be in full force and effect from and after its passage.
