HomeMy WebLinkAbout2023-08-01 ORDINANCE NO.,a DE- 01 AN ORDINANCE TO AMEND THE BATESVILLE ZONING DISTRICTS MAP; AND FOR OTHER PURPOSES. WHEREAS,the Batesville Planning Commission received a request to rezone property on Harrison Street, identified by the Independence County Assessor as parcel number 11003770016; and WHEREAS,the Batesville Planning Commission conducted a properly advertised public hearing on August 7,2023 to hear public comment about the proposed zoning revision; and, WHEREAS,the Batesville Planning Commission,at its regular meeting on August 7,2023,has determined that the proposed zoning revision is consistent with the Batesville Comprehensive Plan,as amended,and is in the best interest of the future development of the city; and, WHEREAS,the Batesville Planning Commission at the same regular meeting,determined that the adjacent parcel at 3030 Harrison Street, identified by the Independence County Assessor as parcel ID 1100377000E and owned by the City of Batesville,would thereby become an isolated R-1 zoning district inconsistent with the Batesville Comprehensive Plan and unlikely to ever be use or available for residential use and should therefore also be rezoned from R-1 to C-1;and, WHEREAS,the Batesville Planning Commission has recommended that the requested amendments to the Zoning Districts map be approved by the City Council. NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BATESVILLE,ARKANSAS: Section 1. The Batesville Zoning Districts Map is hereby amended from Single Family Residential (R-1) to Commercial Community District(C-1)for properties identified by the Independence County Assessor as parcelsl 1003770016 and 1 I00377000E. SECTION 2. If any portion or portions of this ordinance are deemed or held to be invalid, such invalidity shall not affect the remaining portion or portions of this ordinance. IT IS SO ORDAINED.
