Make it Yours! RESOLUTION # Be it resolved by the City Council of the City of Batesville, State of Arkansas a resolution entitled: AUTHORIZING RESOLUTION A Resolution authorizing the Mayor of the City of Batesville to apply for a grant from the Federal Aviation Administration (FAA) on behalf of the Batesville Airport Commission. Whereas, the City Council of the City of Batesville recognizes the need for the project, concurs its importance, and supports the Batesville Airport Commission in its efforts to proceed with the same; and Therefore, be it resolved that the Mayor of the City of Batesville is authorized to sign the application for FAA funding; and Be it further resolved, that the Mayor of the City of Batesville and the City Attorney are hereby authorized to sign the Grant Agreement with the Federal Aviation Administration for purposes of securing grant funds in the amount of $ 600,000.00 or less to aid and assist the Batesville Airport Commission to install a New PAPI System and Replace Runway End Identifier Lights. The Mayor and the Commission Chairman is further authorized to administer the grant funds for the same project. AN ORDINANCE AUTHORIZING THE MAYOR TO TEMPORARILY CHANGE THE HOURS AND DATES FOR ANY CITY ENTERTAINMENT DISTRICT FOR THE CITY OF BATESVILLE, ARKANSAS; AND FOR OTHER PRUPOSES WHEREAS, the State of Arkansas passed into law Act 812 of 2019, hereinafter referred to as "Act 812," to promote hospitality and tourism; to establish areas of a city or town that highlight restaurant, entertainment, and hospitality options; to establish temporary or permanent designated entertainment districts; and for other purposes., and WHEREAS, the City of Batesville currently has established an enterainment district downtown and a temporary entertainment district at riverside park, which may be declared by mayoral proclomation, and WHEREAS, that the current ordinance limits the downtown entertainment district to certain times and dates, and WHEREAS, that there are special events, such as the upcoming eclipse, in which the City wishes to promote business, tourism, and the general enjoyment of said events; and WHEREAS, that authorizing the Mayor to temporarily change the hours or times of operation of the entertainment districts will allow the City the flexibility to promote these goals. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BATESVMLE, ARKANSAS, AS FOLLOWS: Section 1. That the Mayor is hereby authorized to temporarily change the times and hours of operation of any Entertainment District within the city of Batesville, Arkansas. That said temporary changes shall specify the dates and times for said changes through Mayoral proclamation. Section 2. That all ordinances and parts thereof in conflict herewith are hereby repealed to the extent of such conflict. Section 3. If any portion or portions of this ordinance are deemed or held to be invalid, such invalidity shall not affect the remaining portions of this ordinance. Section 4. That the need for passage of this ordinance is immediate. Therefore, it is hereby declared that an emergency exists and this Ordinance being necessary for the immediate preservation of public peace, health, safety and welfare shall be in force and take effect immediately upon its passage. Rick Elumbaugh, Mayor ATTEST: Denise Johnston, City Clerk CITY OF BATESVILLE, ARKANSAS PROCLAMATION Whereas, the City of Batesville has previously created Entertainment Districts within the City, and Whereas, the Mayor of the City is authorized by Ordinance to temporarily change the times and dates of operation of said Entertainment Districts by Proclamation, and Whereas, the upcoming eclipse is a special opportunity, with numerous special events planned, for the promotion of business, tourism, as well as the general enjoyment of our citizens, and Whereas, Mainstreet Batesville has requested that the Entertainment Districts be times and dates be expanded temporarily to support this special event. NOW THEREFORE: It is hereby PROCLAIMED that the Entertainment District in Downtown Batesville, Arkansas is hereby activated and shall be operational on the following days from 10 a.m. until 12 a.m. (Midnight): April 5, 2024; April 6, 2024; and April 7, 2024 Signed this day of . 2024. Rick Elumbaugh, Mayor RESOLUTION # A RESOLUTION AUTHORIZING THE SALE OF THE PROPERTY TO GROW MORE FINANCIAL INVESTMENTS, LLC. WHEREAS, the City of Batesville wishes to encourage growth and tourism; and WHEREAS, the City currently owns property west of Oaklawn Cemetery; and WHEREAS, that Financial Investments, LLC wishes to purchase said property to construct a hotel. NOW, THEREFORE BE IT RESOLVED, BY THE CITY COUNCIL OF THE CITY OF BATESVILLE, ARKANSAS SECTION 1: That the City of Batesville hereby authorizes the sale of the property located south of Ems Drive, East of 14`h Street and Chaney Drive, and west of the western annex of Oaklawn Cemetery to Grow More Financial Investments, LLC for the purchase price of $550,000, more or less. PASSED AND APPROVED this th day of March, 2024. Rick Elumbaugh, Mayor ATTEST: Denise Johnston, City Clerk RESOLUTION # A RESOLUTION AUTHORIZING THE PURCHASE OF PROPERTY FROM EASY STREET LEASING, LLC. WHEREAS, the City of Batesville wishes to encourage the health and well-being of its citizens and visitors; and WHEREAS, the City currently plans to extend its walking trail along the White River; and WHEREAS, that Easy Street Leasing, LLC wishes is agreeable to selling 1.34 acres for said walking trail to the City of Batesville. NOW, THEREFORE BE IT RESOLVED, BY THE CITY COUNCIL OF THE CITY OF BATESVILLE, ARKANSAS SECTION 1: That the City of Batesville hereby authorizes the purchase of the 1.34 acres per the terms of the attached Memorandum of Understanding and proposed Deed with Restrictive Covenants, from Easy Street Leasing, LLC for the purchase price of $10,000, more or less.
