HomeMy WebLinkAbout2024-03-01 ORDINANCE NO.A63 7"D 9-0 I AN ORDINANCE AUTHORIZING THE MAYOR TO TEMPORARILY CHANGE THE HOURS AND DATES FOR ANY CITY ENTERTAINMENT DISTRICT FOR THE CITY OF BATESVILLE,ARKANSAS; AND FOR OTHER PRUPOSES WHEREAS,the State of Arkansas passed into law Act 812 of 2019, hereinafter referred to as "Act 812,"to promote hospitality and tourism;to establish areas of a city or town that highlight restaurant, entertainment,and hospitality options;to establish temporary or permanent designated entertainment districts;and for other purposes.,and WHEREAS,the City of Batesville currently has established an enterainment district downtown and a temporary entertainment district at riverside park,which may be declared by mayoral proclomation,and WHEREAS,that the current ordinance limits the downtown entertainment district to certain times and dates, and WHEREAS,that there are special events, such as the upcoming eclipse, in which the City wishes to promote business,tourism,and the general enjoyment of said events;and WHEREAS,that authorizing the Mayor to temporarily change the hours or times of operation of the entertainment districts will allow the City the flexibility to promote these goals. NOW,THEREFORE,BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BATESVILLE,ARKANSAS,AS FOLLOWS: Section 1. That the Mayor is hereby authorized to temporarily change the times and hours of operation of any Entertainment District within the city of Batesville,Arkansas. That said temporary changes shall specify the dates and times for said changes through Mayoral proclamation. Section 2. That all ordinances and parts thereof in conflict herewith are hereby repealed to the extent of such conflict. Section 3. If any portion or portions of this ordinance are deemed or held to be invalid, such invalidity shall not affect the remaining portions of this ordinance. Section 4. That the need for passage of this ordinance is immediate. Therefore, it is hereby declared that an emergency exists and this Ordinance being necessary for the immediate preservation of public peace,health, safety and welfare shall be in force and take effect immediately upon its passage.
