WHEREAS, the Batesville Planning Commission, during the course of a periodic evaluation and update of the Comprehensive Plan, conducted a public hearing on May 6, 2024 to consider desirable revisions to said Plan; and, WHEREAS, the Planning Commission, at a regular meeting on May 6, 2024, adopted certain revisions to the Plan in the vicinity of E. College Ave and 14th St, as shown at Exhibit A attached hereto, which would enhance the future development of the City of Batesville; and, WHEREAS, the Planning Commission has recommended to the Batesville City Council that it adopt said revision to the Plan; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BATESVILLE, ARKANSAS THAT, the revision to the Batesville Comprehensive Plan as prepared and recommended by the Planning Commission be, and hereby is adopted. ADOPTED THIS DAY OF 52024. AN ORDINANCE TO AMEND THE BATESVILLE ZONING DISTRICTS MAP; AND FOR OTHER PURPOSES. WHEREAS, James Bone has requested that certain properties at the southwest corner of E. College Ave. and 1411' Street be re -zoned in order to facilitate future commercial development of said properties; and, WHEREAS, the Batesville Planning Commission has reviewed the relationship of these properties with the Comprehensive Plan and determined that said Plan should be amended and accordingly did so following a public hearing on May 6, 2024, rendering the proposed re -zoning as consistent with the commercial uses anticipated in said Plan; and, WHEREAS, the Batesville Planning Commission conducted a properly advertised public hearing on May 6, 2024 to consider said proposed amendment to the Zoning Districts Map from General Residential R-2 to Community Commercial C-1; and, WHEREAS, the Batesville Planning Commission voted at its regularly scheduled meeting on May 6, 2024 to approve the requested amendment to the Zoning Districts Map as being in the best interest of the future development of the City of Batesville, and further recommends that the Batesville City Council adopt said amendment to the Zoning Districts Map. NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BATESVILLE, ARKANSAS THAT THE BATESVILLE ZONING DISTRICTS MAP IS HEREBY AMENDED AS FOLLOWS: Section 1: For the following described property from General Family Residential District (R-2) zoning classification to Community Commercial District (C-1) as displayed on Exhibit A attached hereto: A TRACT OF LAND BEING ALL OF 4, 5, 6, & 7 AND BEING ALL THAT PART OF THE VACATED NORTH RIGHT OF WAY OF CENTER STREET THAT LIES SOUTH OF LOT 6 AND LOT 7, ALL IN BLOCK OF HIGHLAND ADDITION TO THE CITY OF BATESVILLE, ARKANSAS AS PLATTED IN BOOK "N-2, PAGE 166" Section 2: IF ANY PORTION OR PORTIONS OF THIS ORDINANCE ARE DEEMED OR HELD TO BE INVALID, SUCH INVALIDITY SHALL NOT AFFECT THE REMAINING PORTION OR PORTIONS OF THIS ORDINANCE. AN ORDINANCE TO AMEND THE BATESVILLE ZONING DISTRICTS MAP; AND FOR OTHER PURPOSES. WHEREAS, the Batesville Planning Commission has reviewed a request to rezone the property located at 1257 N. WHEREAS, the total amount of the contract is $1,282,548.00, more or less, and will be paid from monies collected from the City of Batesville Operating Budget and the Arkansas Department of Transportation's Transportation Alternatives Grant Program. NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL FOR THE CITY OF BATESVILLE, ARKANSAS THAT: Section 1. That the City of Batesville shall accept the low bid and enter into a contract for the construction of the Batesville Main Street Streetscape with Wagner General Contractor, Inc. Section 2. The total amount for the contract is for $1,282,548.00, more or less, and will be paid from the City of Batesville Operating Budget and funds received from the Arkansas Department of Transportation's Transportation Alternatives Grant Program. Section 3. The Mayor and City Clerk are hereby authorized by the City Council for the City of Batesville to execute all documents necessary to effectuate this agreement.
