AN ORDJNNANCE CONCERNING THE BATESVILLE POLICE
DEPARTMENT,DIRECTING THE NUMBER OF POLICE OFFICERS,
DECLARING AN EMERGENCY,AND FOR OTHER PURPOSES.
WHEREAS,the City of Batesville and Independence County currently participate
in an Interlocal Agreement which sets out their respective rights and obligations regarding
law enforcement within the county;
WHEREAS, the present version of the Interlocal Agreement was adopted by the
City of Batesville on July 10,2012, and is set to expire in July of 2017;
WHEREAS, by Ordinance adopted on December 17, 2014,the City of Batesville
opted to withdraw from the Interlocal Agreement concerning law enforcement;
WHEREAS,the notice period set forth in the Interlocal Agreement shall expire
on June 19, 2015, and the arrangement will terminate on that day.
WHEREAS,upon notice of termination of the Interlocal Agreement,the City
intended to create a Police Department in accordance with Ark. Code Ann. §14-52-101.
WHEREAS, in order to prepare for the shift in law enforcement responsibilities,
the City of Batesville desires to formally create its Police Department and, in accordance
with Ark. Code Ann. §14-52-201, direct the number of subordinate police officers to be
appointed.
NOW,THEREFORE,BE IT ORDAINED BY THE CITY COUNCIL OF
BATESVILLE,ARKANSAS:
Section 1. The City of Batesville announced its intention to create a Police
Department upon notice of termination of the Interlocal Agreement,and the Batesville
Police Department is hereby,officially formed.
Section 2. The City Council of the City of Batesville hereby directs that the
Batesville Police Department may have up to sixty (60)appointed subordinate police
officers.
Section 3. This ordinance repeals any ordinances or parts of ordinances in
conflict herewith.
Section 4. EMERGENCY CLAUSE: Because the orderly administration of law
enforcement in the City of Batesville is vital for the protection of life, liberty,and property,
and it being necessary to protect and preserve the health, safety, and welfare of the people
of the City of Batesville, an emergency is declared to exist and this Ordinance shall be in
full force and effect from and after its passage.
