MINUTES OF COUNCIL
APRIL 9, 2024

The Batesville City Council met in regular session on April 9, at 5:30 pm at the
Municipal Building. Mayor Rick Elumbaugh presided over the meeting. Utility Office
Manager Nick Baxter gave the invocation. Upon roll call, the following Councilmembers
answered present; Brittany Bennett, Scott Fredricks, Julie Hinkle, Paige Hubbard, Doug
Matthews, and Chris Poole. Also present were the City Clerk Denise Johnston and City
Attorney Tim Meitzen. Councilmember Fred Krug was absent.
Councilmember Poole moved to approve the minutes from the previous meeting.
Councilmember Bennett seconded and all voted for.
Councilmember Matthews moved to approve the prepared agenda.
Councilmember Hubbard seconded and all voted for.

NEW BUSINESS
A) POLICE DEPARTMENT REPORT
Interim Police Chief John Scarbrough addressed the council with his monthly
report. Chief Scarbrough said the March activity report was average for this time
of year. The Chief said they were in the process of installing the new computers
and printers in their vehicles and are hoping to have them in service soon. He
also reported that he was proud of his officers for their willingness to serve and
protect our citizens and all the visitors during yesterday’s total solar eclipse.
There were activities all weekend and the weather was perfect for the once in a
lifetime experience.
B) ENGINEER’S REPORT
City Engineer Damon Johnson address the council with his monthly report. Mr.
Johnson said the plans for the new Water Treatment Plant are completed and
ready to be sent to the Health Department and several other regulatory
departments for approval. Mr. Johnson said he is planning a meeting between
the WTP project managers and the Parks and Recreation project managers. He
said it is exciting to have two large projects going at the same time and both
groups are looking forward to working with each other to make sure both projects
run smoothly. Mr. Johnson said the Wastewater Plant was having problems with
large turtles getting stuck in their pumps. The damage to the pumps was
extensive, approximately $100,000.00 to repair. He said they recently installed a
large screen to protect 3 pumps from the turtles. The Street Department is
running as usual, patching streets and doing drainage maintenance. He said
they were also working with the railroad company to help improve the track
crossings lower College Street. The railroad will not let the city do any work on
their tracks so they will have to do the improvements. Lastly, Mr. Johnson said
over the past couple of years, he has been working on an issue in Quail Valley.
At the intersection of Quail Valley Drive and Whippoorwill Lane, there is an area
that has been used to create a shortcut forming a triangle. That area is actually
on private property and the owner of the property has asked the city to widen the
intersection and block off that area of his property so vehicles can’t drive on it.
Mr. Johnson said they have widen the intersection of Quail Valley Drive and
Whippoorwill Lane and hopes to have the triangle issue remedied soon.
C) FIRE DEPARTMENT REPORT
Fire Chief Mark McCollum addressed the council with his monthly report. His
March report shows 41 incidents, 446 training hours. He also said his
department has been busy with several new business inspections.
D) CONSIDER A RESOLUTION CERTIFYING LOCAL GOVERNMENT
ENDORSEMENT OF BADBOY INC. TO PARTICIPATE IN THE TAX BACK
PROGRAM OF THE CONSOLIDATED INCENTIVE ACT OF 2023
Councilmember Reeves introduced a resolution of endorsement of BadBoy, Inc.
to participate in the Tax Back Program of the Consolidated Incentive Act of 2003.
Councilmember Matthews moved to suspend the rules and read the resolution by
title only. Councilmember Fredricks seconded and the electronic roll call count
was 7 for and 0 against. Mr. Meitzen read the resolution by title only. After a
discussion, Councilmember Matthews moved to adopt the resolution.
Councilmember Fredricks seconded and the electronic roll call count was 7 for
and 0 against. The resolution was given #2024-04-01-R.
E) EXECUTIVE SESSION
Councilmember Fredricks moved to go into executive session and
Councilmember Bennett seconded. All voted for. Upon returning from executive
session, no decisions were made.
F) FINANCIAL REPORT
The council was given a copy of the March, 2024 financials for review.
MAYOR COMMENTS

Mayor Elumbaugh said the next meeting will be April 23. The Mayor asked for
approval to pay for new lane line ropes for the indoor pool at the Aquatics Park out of
the Community Center and Aquatics Park Maintenance Fund. The cost for the ropes is
$9,223.75. Councilmember Poole moved to pay the expenditure out of the
maintenance fund. Councilmember Hinkle seconded and all voted for.

ADJOURNMENT
There being no further business, Councilmember Fredricks moved that the
meeting be adjourned. Councilmember Hubbard seconded and all voted for. The
meeting was adjourned at 6:12 p.m.
