HomeMy WebLinkAbout2023-03-14 MINUTES OF COUNCIL MARCH 14, 2023 The Batesville City Council met in regular session on March 14, at 5:30 pm at the Municipal Building. Mayor Rick Elumbaugh presided over the meeting. Utility Office Manager Nick Baxter gave the invocation. Upon roll call, the following Councilmembers answered present; Tommy Bryant, Scott Fredricks, Julie Hinkle, Paige Hubbard, Fred Krug, Doug Matthews, and Chris Poole. Also present were the City Clerk Denise Johnston and City Attorney Tim Meitzen. Councilmember Brittany Bennett was absent. Councilmember Hinkle moved to approve the minutes from the previous meeting. Councilmember Fredricks seconded and all voted for. Councilmember Hubbard moved to approve the prepared agenda. Councilmember Bryant seconded and all voted for. CITIZENS COMMENTS Mr. Justin Angel addressed the council with several questions regarding the upcoming Water Treatment Plant renovation. Mayor Elumbaugh explained to Mr. Angel that the time allotted for citizens to make comments is not a dialog with the council, only the citizens comments. However, the Mayor told Mr. Angel that he could present his questions to the Mayor or appropriate person and get the answers he is requesting. UNFINISHED BUSINESS None NEW BUSINESS A) POLICE DEPARTMENT REPORT Police Chief Alan Cockrill addressed the council with his monthly report. Chief Cockrill gave the council a detailed report showing accidents, and arrests for February, 2023. The Chief also said the radar signs are in their final test phase and should be here and installed within the next couple of weeks. B) ENGINEER’S REPORT City Engineer, Damon Johnson, addressed the council with his monthly report. Mr. Johnson said the construction department is working on completing the patch work on Broad Street to get it ready for paving as soon as the paving company can get to it. The Contract Section III is progressing, although slower than anticipated. All other departments are running as expected. C) FIRE DEPARTMENT REPORT Fire Chief Mark McCollum addressed the council with his monthly report. The Chief said his department had 243 training hours in February, 80 inspections and 38 fire runs. He said the tower truck was in St. Louis for repairs. The truck is a 2007, therefore, parts are hard to find for repairs. Councilmember Bryant noted that the tower truck is the only truck that we have that will reach the top floor of the hospital. D) CONSIDER AN ORDINANCE FOR APPROVAL OF AN APPLICATION FOR PRIVATE CLUB PERMIT GOOD DOG SOCIAL CLUB, INC. Councilmember Bryant introduced an ordinance to approve the application for a private club permit for Good Dog Social Club, more commonly known as Mi Pueblito Mexican Restaurant. Councilmember Fredricks moved to suspend the rules and read the ordinance by title only. Councilmember Bryant seconded and the electronic roll call count was 7 for and 0 against. Mr. Meitzen read the ordinance by title only. Councilmember Bryant moved to further suspend the rules and waive the second and third readings. Councilmember Fredricks seconded and the electronic roll call count was 7 for and 0 against. Councilmember Bryant moved to adopt the ordinance and Councilmember Hinkle seconded. The electronic roll call count was 7 for and 0 against. The ordinance was given #2023-03-01. Mr. Meitzen read the emergency clause. Councilmember moved to adopt the emergency clause and Councilmember Fredricks seconded. The electronic roll call count was 7 for and 0 against. E) CONSIDER AN ORDINANCE TO AMEND THE BUDGET ADOPTED DECEMBER 14, 2021 FOR THE TWELVE MONTHS BEGINNING JANUARY 1, 2022 Councilmember Poole introduced an ordinance to amend the adopted 2022 budget for the City of Batesville and Batesville Utilities. Councilmember Hubbard moved to suspend the rules and read the ordinance by title only. Councilmember Bryant seconded and the electronic roll call count was 7 for and 0 against. Mr. Meitzen read the ordinance by title only. Councilmember Hubbard moved to further suspend the rules and waive the second and third readings. Councilmember Bryant seconded and the electronic roll call count was 7 for and 0 against. Councilmember Bryant moved to adopt the ordinance and Councilmember Hubbard seconded. The electronic roll call count was 7 for and 0 against. The ordinance was given #2023-03-02. F) EXECUTIVE SESSION Councilmember Hubbard moved to go into executive session to consider an appointment to the Planning and Zoning Commission. Councilmember Bryant seconded and all voted for. Upon returning from executive session, Councilmember Bryant moved to appoint Mr. Lacky Moody to the Planning and Zoning Commission. Councilmember Poole seconded and all voted for. Mr. Bryant said he will replace Mr. Cord Davidson who resigned his position which will expire June 10, 2024, however, Mr. Bryant said Mr. Moody’s term will extend to June 10, 2028. G) FINANCIAL REPORT The council was given a copy of the February, 2023 financial report for review. MAYOR COMMENTS Mayor Elumbaugh congratulated the Batesville Pioneer Swim for winning the State 5A swim meet. He said he hopes to be able to bring them to the council for recognition soon. The Mayor asked the council to look at their calendars to hold a retreat in April. The retreat will be at Councilmember Tommy Bryant’s farm. The date decided on was th April 20 at 5:30 pm. LIAISON REPORTS None COUNCIL COMMENTS th Councilmember Fredricks reported a street light out at 703 15 Street. Mayor Elumbaugh said he will report the outage. ADJOURNMENT There being no further business, Councilmember Matthews moved that the meeting be adjourned and Councilmember Bryant seconded. All voted in favor.
