MINUTES OF COUNCIL
JULY 25, 2023
The Batesville City Council met in regular session on July 25, at 5:30 pm at the
Municipal Building. Mayor Rick Elumbaugh presided over the meeting. Utility Office
Manager Nick Baxter gave the invocation. Upon roll call, the following Councilmembers
answered present; Brittany Bennett, Tommy Bryant, Scott Fredricks, Julie Hinkle, Fred
Krug, Doug Matthews, and Chris Poole. Also present were the City Clerk Denise
Johnston and City Attorney Tim Meitzen. Councilmember Paige Hubbard was absent.
Councilmember Bryant moved to approve the minutes from the previous
meeting. Councilmember Hinkle seconded and all voted for.
Councilmember Hinkle moved to approve the prepared agenda and
Councilmember Bryant seconded. All voted for.

UNFINISHED BUSINESS
A) THIRD READING OF AN ORDINANCE REQUIRING KNOX BOXES AT CERTAIN
COMMERCIAL AND MULTI-FAMILY RESIDENTIAL BUILDINGS
The first item to discuss in unfinished business is the third reading of an
ordinance to require Knox Boxes at certain commercial and multi-family
residential buildings. Councilmember Hinkle moved to suspend the rules and
read the ordinance by title only. Councilmember Bryant seconded and the
electronic roll call count was 7 for and 0 against. Mr. Meitzen read the ordinance
by title only. After a brief discussion, Councilmember Poole moved to adopt the
ordinance. Councilmember Bryant seconded and the electronic roll call count
was 7 for and 0 against. The ordinance was given #2023-07-02. Mr. Meitzen
read the emergency clause. The emergency clause failed for the lack of a
motion.
B) THIRD READING OF AN ORDINANCE ADOPTING VARIOUS FEDERAL AND
STATE CODES
Next on the agenda is the third reading of an ordinance to adopting various Federal
and State Codes. Councilmember Matthews moved to suspend the rules and read
the ordinance by title only. Councilmember Bryant seconded and the electronic roll
call voted was 7 for and 0 against. Mr. Meitzen read the ordinance by title only.
After a discussion, Councilmember Bryant moved to adopt the ordinance.
Councilmember Matthews seconded and the electronic roll call vote was 7 for and
0 against. The ordinance was given #2023-07-03. Mr. Meitzen read the
emergency clause. The emergency clause failed for the lack of a motion.
NEW BUSINESS
A) CONSIDER AN ORDINANCE AMENDING THE PERPETUAL MAINTENANCE
FUND FOR THE BATESVILLE COMMUNITY CENTER AND AQUATICS PARK
AND OUTDOOR TENNIS COURTS AT FITZHUGH
Councilmember Bryant introduced an ordinance to increase the City’s annual
contribution to the Perpetual Maintenance Fund for the Batesville Community
Center & Aquatics Park and Outdoor Tennis Courts, located at Fitzhugh Park from
$75,000.00 to $100,000.00. Councilmember Bryant explained the reasoning for
setting up the maintenance fund and the importance of keeping the parks in good
condition. Councilmember Matthews moved to suspend the rules and read the
ordinance by title only. Councilmember Bryant seconded and the electronic roll call
count was 7 for and 0 against. Mr. Meitzen read the ordinance by title only.
Councilmember Bryant moved to further suspend the rules and waive the second
and third readings. Councilmember Bennett seconded and the electronic roll call
count was 7 for and 0 against. Councilmember Bryant moved to adopt the
ordinance. Councilmember Poole seconded and the electronic roll call count was 7
for and 0 against. The ordinance was given #2023-07-04.
B) CONSIDER AN EMERGENCY ORDINANCE ADOPTING CERTAIN RULES
AND REGULATIONS CONCERNING EXTERNAL NOISE ATTENUATION OF
DATA CENTERS AND TO PREVENT NOISE DISTURBANCE IN THE CITY OF
BATESVILLE
Councilmember Poole introduced an ordinance to regulate and prevent
unreasonable noise emanating externally from Data Centers. Councilmember
Matthews moved to suspend the rules and read the ordinance by title only.
Councilmember Bryant seconded and the electronic roll call count was 7 for and 0
against. Mr. Meitzen read the ordinance by title only. Councilmember Bryant
moved to further suspend the rules and waive the second and third readings.
Councilmember Matthews seconded and the electronic roll call count was 7 for and
0 against. Councilmember Bryant moved to adopt the ordinance. Councilmember
Matthews seconded and the electronic roll call count was 7 for and 0 against. The
ordinance was given #2023-07-05. Mr. Meitzen read the emergency clause.
Councilmember Matthews moved to adopt the emergency clause. Councilmember
Bryant seconded and the electronic roll call count was 7 for and 0 against.
MAYOR ANNOUNCEMENTS
Mayor Elumbaugh said the next meeting will fall on the special election on

August 8. After a discussion, Councilmember Hinkle moved to only have one meeting
th
in August on the 15. Councilmember Krug seconded and all voted for.
Mayor Elumbaugh asked City Engineer Damon Johnson to address the council
to explain the 2 issues in the upcoming special election. Mr. Johnson said the citizens
of Batesville are being asked to extend the current 1¢ Wastewater Treatment Plant tax
for the construction of a new Water Treatment Plant and to refinance the current 1/2¢
Parks and Recreation tax to enhance our Parks system. Mr. Johnson gave the
background on the current taxes and information on the proposed projects.
The council was given a pay request for a pool filtration pump replacement. The
total cost is $12,420.40 and will be paid out of the Community Center Perpetual
Maintenance Fund. Councilmember Fredricks moved to pay the requested expenditure.
Councilmember Bennett seconded. All voted for.
LIAISON REPORTS

COUNCIL COMMENTS
Councilmember Bennett commented that the splash pad in West Batesville is
always in use. She said she passes by the park several times a day and it is always full
of children.
Councilmember Hinkle praised the Street Department for the repairs made on

20 Street.
ADJOURNMENT
There being no further business, Councilmember Bennett moved that the
meeting be adjourned. Councilmember Matthews seconded. All voted for. The
meeting was adjourned at 6:26 pm.
